1985-295RESOLUTION NO. 85R-295
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING CERTAIN CITY OFFICERS
AND EMPLOYEES TO PERFORM CERTAIN ACTS ON
BEHALF OF THE CITY IN LITIGATION MATTERS AND
OTHER PROCEEDINGS.
WHEREAS, the City of Anaheim ("City"), in its corporate
capacity as a public entity and municipal corporation, is from time
to time a party to various matters of litigation; and
WHEREAS, it is often necessary or desirable for the City to
perform certain acts relating to such litigation matters which acts
can either only be performed or are most appropriately performed by
certain officers or employees of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that:
1. The City Attorney of the City is hereby authorized, at his
or her discretion, to acknowledge receipt of service by mail of any
summons and complaint or other pleading upon the City. Nothing
contained herein shall authorize the City Attorney to acknowledge
receipt of service by mail of any summons and complaint or other
pleading on behalf of any individual officer or employee of the City
without the express consent of such officer or employee.
2. The City Attorney is hereby authorized to verify any
pleadings for and on behalf of the City as he or she may deterir-ine
to be necessary or desirable.
3. The City Manager, City Attorney and all other department
heads of the City are hereby authorized to assemble and verify
answers to interrogatories, requests for admissions, responses to
notices to produce evidence, and responses to other discovery
matters in legal proceedings for and on behalf of the City.
4. The City Attorney is authorized to stipulate to
continuances of matters set for hearing before the City Council
except for hearings of which notice thereof is required by law to be
given to persons other than the applicant.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 9th day of July, 1985.
