EXCEPT the North 143.00 feet thereof. Parcel 2: The North 143.00 feet 0 f Lot 16 olf Tract No. 4703, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 169, pages 25 and 26 of Miscellaneous Maps, in the Office of the County Recorder of said County. ~, AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on July 3l~ 1967 , notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC67-169 ~~ 1.,.. , reconnnending that Variance No. 1896 be itranted. in part. sub; ect to certain conditions therein set forth ; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission grantina. in Dar~ said variance, and said appeal was set fot Qub1ic hearing on September 19 , 19 67 , at 1:'3(:) oVc1ock P.M. at the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: -1- ..-. ~ 1. There are exceptional or extr~ordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVEO by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the establishment of a billiard parlor and a pizza parlor, with on-sale beer, on Parcel No.1 hereinbefore described, and permitting a lot having no frontage on a dedicated street, said lot being hereinbefore described as Parcel No. 2 (Section 18.08.440 of the Anaheim Municipal Code), subject to the following conditions: 1. That a Parcel Map to record the approved division of subject property shall be su~itted to the City of Anaheim for approval, and then recorded in the Office of the Orange County Recorder. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 4. That the owner of Parcel No. 1 shall submit to the City Attorney satisfactory evidence of a recorded easement which will provide perpetual ingress and egress to and from Parcel No.2, prior to the issuance of a building permit for any structure to be constructed on Parcel No.2. 5. That plans of development for Parcel No.2 shall be submitted to the City Council for approval of the access proposed through and across Parcel No.1, prior to the issuance of a building permit for any structure to be constructed on Parcel No.2. 6. That adequate provision shall be made to provide for continued and uninterrupted use of the drainage channel in the event the westerly portion of the two parcels hereinbefore described is used for parking purposes. - -2- ... 0--' 7. That Condition No. 1 above-mentioned shall be complied with prior to the iss~.nee of a building permit or within a period of ]80 days from date hereof, whichever occurs first, or such further time as the City Council may ~rant. 8. That Conditions Nos. 2, 3 and 6 above-mentioned shall be complied with prior tp final building and zoning inspections for Pan:e1 No.2. 9. That signing shall be in conf~ce with the signing in the industrial tracjt. The City Council hereby reserves the right to revoke such variance permit for good cause or 'failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescrjibed by the Anaheim MUnicipal Code unless otherwise specif~ed herein.
