A RESOLUTION OF THE CITY.COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AND DIRECTING
THE CITY ATTOP~EY TO ENTER INTO Jill AGREE-
MENT OF RESCISSION ON A CE~TAIN OPTION TO
LEASE, A1~D AUTHORIZING AND DIRECTING THE
DIRECTOR OF FINANCE TO REFUND ALL MONIES
PAID TO THE OPTIONEE.
wnEREAS, heretofore, on or about the 1st day of January,
1967, the City of Anaheim as 1l0ption<l>r" did enter into an Option
to Lease certain City-controlled property contiguous to the
Anaheim Convention Center to Anaheim Transportation Center as
HOptionee,1l said option being presently current in its period
of extension, and
vlliEREAS, the City of Anaheim desires at this time to
effect a cancellation of said option so that it can use the prop-
erty involved for much needed "employee" parking, and
~rrIEREAS, Optionee has heretofore paid to the City of
Anaheim the sum of $10,000.00 in connection with said Option to
Lease; and
WtiEPEAS, Optionee is willing to cancel said option if
the City of Anaheim is willing to return to Optionee the monies
heretofore paid by Optionee for said option, and
WHEREAS, the City Council of the City of Anaheim finds
that it is in the best interests of the City, in the orderly use
and development of the Anaheim Convention Center, to cancel said
option and to return the monies paid therefor to said Optionee.
NOW, THEREFOP..E, BE IT HESOLVED by the City Council of
the City of Anaheim that it authorize, and it does hereby autho-
rize and direct, the Office of the City Attorney to take what-
ever steps are necessary to accomplish the cancellation of said
Option to Lease.
BE IT FURTHER RESOLVED that the Director of Finance be,
and he is hereby, authorized and directed to deliver a warrant of
the City of Anaheim to the Office of the City Attorney, said
warrant to be in the amount of $10,000.00 and made payable to
Anaheim Transportation Center.
~~D BE IT FURTHER RESOLVED that the City Attorney's
Office be, and it is hereby, authorized and directed to deliver
said warrant to the attorney for Anaheim Transportation Center
when it holds a cancellation of said Option to Lease.
THE FOREGOING P~SOLUTION is approved and signed by me
this 29th day of August, 1967.
