RESOLUTION NO. 67R~430 ,~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND D~TERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULP BE AMENDED AND THAT THE BOUNDARIES OF CE~TAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Co~ssion of the City of Anaheim did hold a public hearing in Replassification Proceed- ings No. 66-67-74 to con~ider an amendment to Title 18 of the Anaheim Municipal Code ~elating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, anp at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a $ummary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and reco~ndation of the City Planning Commission the City Council did fix the 1st day of August , 19 67 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described~ from the zone or zones in which it'is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary'of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the'amendment to Title' 18 of the Anaheim Municipal Code should be adopted and th~tthe property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. ,- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of california, to wit: -1- 66-67-74 --.. ..- That portion of the Firs.t Class Land allotted to R. Rivas according to a map attached to and made a part of the Decree of Partition of the Rancho Cajon de Santa Ana, rendered in Case No. 1978 of the l7ti.'l Judicial District Court of Cali- fornia, a certified copy of which is recorded in Book 28, Page 158 of Deeds, in the office of the County Recorder of Los Angeles County, located in the County of Orange, State of California, described as follows: Beginning at a point in the existing City limit line of the City of Anaheim, as established by the Yorba Annexation passed November 13, 1962, by Ordinance No. 1777, filed with the Secretary of State August 10, 1964 and recorded August 13, 1964 in Official Records of Orange County, California, said point of beginning being the Northeast corner of that certain parcel of land conveyed to Maurice R. Burnell and Jean C. Burnell, husband and wife, by deed recorded November 13, 1956, in Book 3708, page 61 of Official Records of Orange County, California, said Northeast corner and point of ' beginning being distant from the center line intersection of Orchard Drive and Orangethorpe Avenue the following courses and distances: North 30 26' 30" East 1,120.42 feet, more or less; North 770 30' 00" West 426 feet, more or less; North 110 55' 00" East 330 feet, more or less. The inter- section of said center line of Orchard Drive and Orangethorpe Avenue is shown on a Map of Tract No. 4181, recorded in Book 156, pages 21, 22, and 23 of iti.scellaneous Haps, records of Orange County, California; thence 1. North 770 30' 00" West 244 feet, more or less, along a portion of the said existing City of Anaheim City limit line to an intersection with the Easterly right of way line of Orchard Drive (40 feet wide) as shown on a Record of Survey Map filed in Book 2, page 18 of Record of Surveys in the office of the County Recorder of said Orange County, Cali- fornia; thence 2. South 110 55' 00" vlest 310 feet, more or less, leaving the said existing City limit line of the City of Anaheim and following along a portion of the Easterly right of way line of said Orchard Drive (40 feet wide) to an intersection with the Northerly right of way line of Orchard Drive (40 feet wide) as said intersection is shown on the aforementioned Record of Survey Map filed in Book 2, page 18 of Record of Surveys, in the office of the County Recorder of said Orange County, California; thence 3. South 770 30' 00" East 244 feet, more or less, along the Northerly right of way line of the last mentioned Orchard Drive to an intersection with the Easterly line of the land conveyed to the aforementioned Maurice R. Burnell and Jean c. Burnell, husband and wife, said point of intersection also being in the existing City of Anaheim City limit line as established by the aforementioned Yorba Annexation; thence ,~ 4. North 110 551 00" East 310 feet, more or less, along the said existing City of Anaheim City limit line, also being the Easterly line of the land conveyed to said !1aurice R. Burnell and Jean C.
