92-105 RESOLUTION NO. 92R-105 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 3417 AND AMENDING RESOLUTION NO. PC91-74. WHEREAS, the Anaheim Planning commission heretofore adopted Resolution No. PC91-74 approving Conditional Use Permit No. 3417, subject to certain conditions specified therein; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the Anaheim Planning Commission heretofore conducted a duly noticed public hearing upon said request after which the Planning Commission adopted its Resolution No. ¥~9~-~ ~ denying said request; and PC92-46 WHEREAS, within the time permitted by law, said decision was appealed to the City Council; and WHEREAS, the City Council held a duly noticed public hearing on June 2, 1992, at which hearing the city Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the City Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 3417 be, and the same are hereby, amended by the amendment of Conditions Nos. 1 and 11 as set forth in Resolution No. PC91-74 to read as follows: "1. a. That subject medical office trailer shall be permitted to operate on-site (1) one day every week. The trailer shall be delivered to the site no earlier than 7:00 a.m. on the day of operation and shall be removed no later than 9:00 p.m. on the day of operation. The air conditioner for the unit shall not be operated prior to 7:00 a.m. CUP #3417 b. That the noise reduction measures recommended in the noise study dated May 29, 1992 and titled "MRI Trailer Air Conditioning Noise" shall be installed and maintained in connection with the MRI trailer operation to reduce the noise to the levels specified in said sound study. 11. That this Conditional Use Permit is granted for a period of one (1) year until June 3, 1993, at which time the use shall terminate unless a time extension is requested by the petitioner and granted by the Planning Commission (or by the City Council if appealed) following a duly noticed public hearing." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution No. PC91-74 shall remain in full force and effect. BE IT FURTHER RESOLVED that Resolution No. PC92-46 be and the same is hereby, superseded and of no further force or effect. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 2nd day of June, 1992.
