A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED CONVEY-
ING TO THE CITY OF ANAHEIM CERTAIN REAL PROP-
--- ERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES. (R/W #3500-79)
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property
for municipal purposes, to wit: An easement for road and public
utility purposes; and
WHEREAS, the owner of said property has offered to sell
and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of
Anaheim to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of ANAHEIM POST NO. 72 THE
AMERICAN LEGION, DEPARTMENT OF CALIFORNIA, A CORPORATION, to sell
to the City of Anaheim the following described real property
situated in the City of Anaheim, County of Orange, State of
California, to be used for an easement for road and public
utility purposes, and more particularly described as follows:
An easement for road and public utility purposes over,
upon, across, and within a spandrel-shaped portion of
Lot 1 in Block A of Tract No. 143, as shown on map
thereof recorded in Book 11, page 38, of Miscellaneous
Maps, Records of the Recorder of said County, bounded as
follows:
Bounded on the North by the Northerly line of said Lot 1;
Bounded on the West by the Westerly line of said Lot l;
and
Bounded on the Southeast by the arc of a 15.00-foot
radius circular curve concave Southeasterly and tangent
to each of the two above described boundaries,
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property; provided, however, that nothing herein shall be
construed to be an acceptance of any parcel or property into the
City street system (Section 1806, Streets and Highways Code).
BE IT FURTHER RESOLVED that the Accounting Officer of
the City of Anaheim be, and he is hereby, authorized to issue a
warrant and pay to the owner of said real property, out of General
Funds of the City of Anaheim and charged to Account No.
12-792-7101-E2747 the sum of Two Thousand Four Hundred Dollars
(2,400.00).
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of July, 1985.
