1967-396 -. ,r- RESOLUTION NO. 67~-396 A RESOWTION OF THE CITY CO;CIL OF THE CITY OF ANAHEIM ACCEPTING A SEA D PROPOSAL AND AWARDING A CONTRACT TO THE WEST RESPONSIBLE BIDDER FOR THE FURNISHING 0 , ALL PLANT, LABOR, SERVICES, MATERIALS AND EQU~PMENT AND ALL UTILITIES AND TRANSPORIlTIO , INCLUDING POWER, FUEL AND WATER, AND PERFOR NG ALL WORK NECES- SARY TO CONSTRUCT AND COMP TE THE FOLLOWING PUBLIC IMPROVEMENT~ ~~~~=* ~~ C:~O~ ~~nTH RIVER TRUNK SEWER I . WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper ~f general circulation, printed, published and circulated in ~he City of Anaheim, to wit~ The Anaheim Bulletin , on the 29th day of June and the 6th day of Jul~. 1967 a notice inviting sealed proposals for furnishing the following: All plant, labor, services, materials and equipment, and all utilities and transportation, including power, fuel and water, and performing all work necessary tQ construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the city Engineer or City Clerk of the City of Anaheim, the following public improvement, to wit: The Santa Ana Canyon South River Trunk Sewer Improvement, consisting of the construction of a 12, 15 and 27-inch V.C.P. sewer line, including required fittings, 900 feet north of the Santa Ana Canyon Road from 1900 feet east of Imperial Highway to 230 feet west thereof, and 1900 feet east of Imperial Highway from 1240 feet north of the East Bound Santa Ana Canyon Road to 55 feet south thereof (all distances approximate), partly in the City of Anaheim and partly in the County of Orange, includ- ing excavation, backfill and compaction; construction of 4 and 5-foot I.D. manholes and a sewerage lift station complete in place; resurfacing with 3-inch asphaltic concrete; jack- ing minimum 30 and 48-inch steel casing; clearing and grub- bing, and appurtenant work as more ~articularly set forth in the plans and specifications on file in the Ofiice, of the City Clerk or City Engineer, Job NQ. 1-310. .- in accordance with the design, plans, profiles and specifica- tions of said public improvement on file in the Office of the City Clerk of the City of Anaheim; and WHEREAS, said notice invit~ng sealed proposals for said public improvement did provide that sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of the City of Anaheim up to the hour of 2~OO o9clock P.M. on the 13th day of July , 19 67 , for the furnishing of all plant, labor, services, materials iti(J"""equipment, all utili- ties and transportation, including p~wer, fuel and water, and performing all work necessary to con~truct and complete in a good and workmanlike manner, the public i~provement hereinabove more -1- Jil ~ T I - particularly mentioned and described, a~d which notice did state and declare that pursuant to the provistons of Section 1770 of the Labor Code, the City Council of the City of Anaheim had as- .~ certained the prevailing rate of wages in the locality in which this type of labor is to be performed f~r each craft or type of workman or mechanic needed to execute the contract, and which wage scale is on file in the Offices of the City Clerk and City Engineer. AND WHEREAS, the City Engine~r did thereupon examine and tabulate said sealed proposals and did report to the City Council the result of his examination and tabulation; and WHEREAS, the City Council finds that the sealed proposal submitted by DATELINE PIPE CONTRACTIN~, INC., 1231 North Lemon, Anaheim California, is the lowest responsible proposal submitted for the furnishing of all plant, labor, services, materials and equipment, all utili- ties and transportation, including pow~r, fuel and water and per- forming all work necessary to construct and complete in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in the Office of the City Clerk of the City of Anaheim, the public improvement hereinabove mention- ed and described, together with the appurtenances thereto, and as specified in the notice inviting sealed proposals, and that said proposal of said above-named bidder should be accepted and a con- tract awarded to said bidder in accordance therewith; and A""""'"'- WHEREAS, the City Council finds that the above-mentioned sealed proposal is the lowest responsible proposal received and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation and that the proposal sub- mitted is the best suited and fitted for the public improvement to be constructed. \ j NOW, THEREFORE, BE IT RESOL~ED by the City Council of the City of Anaheim, that the sealed proposal submitted by DATELINE PIPE CONTRACTING INC tor the furnishing of all plant, labor, services, materials and equipment, all utilities and transporta- tion, including power, fuel and water, and performing all work -2- 1 - ,....- necessary to construct and complete, in a good and workmanlike manner, in strict accordance with the specifications, plans and drawings therefor on file in' the Office of the City Clerk of the City of Anaheim and the notice inviting sealed proposals, the public works and improvement hereinabove more particularly men- tioned and described, together with the appurtenances thereto, be, and the same is hereby, accepted, .nd that a contract for the construction and completion of sai~ public improvement be, and the same is hereby, awarded to the said above-named bidder. AND BE IT FURTHER RESOLVED th~t the successful bidder or bidders upon each contract awarded as ~ereinabove set forth, shall be, and they are hereby required to ex~cute a contract in the re- quired form with the City of Anaheim ueon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by said successful bidder or bidders and in accordance with the plans and specifications for said public improvement here- inabove described, and in accordance with the terms, conditions and provisions of this resolution, and that said successful bidder or bidders to whom each contract is awarded shall be required to fur- nish a surety bond in an amount equal to one hundred per cent(lOO%) of the contract price for all labor, materials and equipment to be furnished and performed, as set forth in the sealed proposal sub- mitted by said bidder for the construction of said public improve- ment, together with the appurtenances thereto or such portion there- of as is covered by said contract, as security for the faithful performance ~f said contract and a separate surety bond in an aoount equal to one hundred per cent (100%) of the construction cost of said public improvement covered by said contract, as security for the payment of all persons performing labor and furnishing material for said project. AND BE IT FURTHER RESOLVED that said successful bidder or bidders be, and they are hereby required to furnish to the City of ~~aheim in companies satisfactory to the City of Anaheim, public liability, property damage, compensation, and other insurance in the amounts and for the purposes as set forth and specified in the notice inviting sealed proposals, and subject to the approval of the City Attorney as to form and suffi,ciency. AND BE IT FURTHER RESOLVED tnat the Mayor and the City Clerk'of the City of Anaheim be, and they are hereby, authorized and directed to make, execute and enter into, for and on behalf of the City of Anaheim, a written contract with said successful bid- der or bidders for the furnishing of all plant, labor, materials, and equipment and performing all work, as hereinabove more particu- larly described, for the construction, installation and completion of said public improvement hereinabove described upon the terms and conditions as specified in the notice inviting sealed proposals, the detailed design, plans, profiles, drawings and general specifi- cations and detailed specifications and drawings, and all add~nda thereto, and all modifications incorporated therein prior to the date of the opening of bids, on file in the Office of the City Clerk of the City of Anaheim and in strict accordance with the terms, conditions and provisions of this resolution, and in accordance with all of the contract documents herein specified.
