1982-070 -. RESOLUTION NO. 82R-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCB NO. 3249 .~. WHEREAS, after a request for variance by TERRA FIRMA PROPERTIES, INC., owner; INVESTORS DEVELOPMENT OF ORANGE COUNTY, INC., agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3249 was granted covering the following described property: The land referred to in this Report is situated in the State of California, County of Orange, City of Anaheim, and is described as follows: PARCEL 1: Parcel 2, as shown on a lot line adjustment plat no. 75, recorded in book 13913, pages 1132 and 1133, official records, in the office of the county recorder of said county. PARCEL 2: Parcel 2, as shown on a parcel map no. 80-238 recorded in book l4S, pages 37 to 38, inclusive of parcel maps, in the office of the county recorder of Orange County, State of California; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, ~aused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privi- leges enjoyed by other property under identical zoning classtfication in the vicinity. ~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted permitting a one-lot, IS-unit condominium sub- division on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: -1- -. SECTION 18.31.061.012 Minimum lot area per dwelling unit. (3000 sq. ft. required; 2804 sq. ft. proposed) SECTION 18.31.063.030 Minimum recreational/leisure area per dwelling unit. (1000 sq. ft. required: 829 sq. ft. proposed) ,.....,... That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 81-82-11, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No.1 of Exhibit Nos. 1 and 2. BE IT FURTHER RESOLVED that the Anaheim City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the con- ditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final jUdg- ment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
