1982-103 ~.~ RESOLUTION NO. 82R-103 A RESOLUTION OF '!'HE CITY COUNCIL OF THE CITY OP ANAHEIM OlWft'IIIO COHDIlIONAL USE PERMIT NO. 2285 WHEREAS, the City Plannin$ Commission ot the City ot Anaheim did receive an application for a conditional use permit from the SOUTHLAND CORPORATION, owjner, and GLENN S. WASLIEN, agent, to permit a convenience market with gasoline sales on certain real property located with~n the City of Anaheim, County of Orange, State of California, legally described as: Lot 6 of Tract No. 3091, as p~r map recorded in Book 92, Pages 48 and 49 of M~scellaneous Maps, in the Office of the County Recorder of said Countyr and -1- ATTV-Z6 (Pqe 1 of Z......) ~1'-. -4 ..c.. WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired hy law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal COde, and .~ WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and repQrts offered at said hearln9t did adopt its Resolution No. PC82-2 , denyinq Conditional Use Permit No. 22~3 ,and MIEREAS, thereafter, within the time prescribed by law, an interested party or the City Counc~l, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing, and WHEREAS, at the time and pl~ce fixed for said public hearing, the City Council did duly hol~ and conduct such hearing and did give all persons interested t~rein an opportunity to be heard and did receive evidence and repprts; and MIEREAS, the City Council fi~ds, after careful consider- ation of the recommendations of the Ci~y Planning Commission and all evidence and reports offered at sald hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anahei~ Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular,area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditio~al use permit under the conditions imposed will not be detrime~tal to the peace, health, safety and general welfare of the cititens of the City of Anaheim. .iF"""""---......" NOW, THEREFORE, BE IT RESOLVIj;D by the City Council of the City of Anaheim that the action of the City Planning Commission ~nYinq said conditional use permit be, and the same is · reby, reversed and that Conditional Use Permit NO.2285 be, and the same is hereby, granted permitting a convenience market with gasoline sales on the hereinabove described property, sub- ject to the following conditions: --2- ATTY-26 (PIlle 2 of 2 PIlg.5) .-. ..-- 1. That the most easterly driveway on Ball Road shall be removed and replaced with a standard curb, gutter and sidewalk. _. 2. That the owner of subject property shall submit a letter requesting the termination of Variance No. 645 to the Planning Department. 3. That an attendant shall be on duty at all times for the purpose of dispensing gasoline. 4. That the proposed Convenience ~arket with gasoline sales shall comply with all signing requirements of the CL zoning. 5. That subject property shall be developed substantially in accordance with plans and specificati~ns on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 6. That the most easterly driveway access on Ball Road shall be closed in conformance with the standatds established by the City Engineer. 7. That water and air service shall be provided for motorists in connection with the gasoline sales. 8. That the gasoline facilities and sales shall conform to the City Fire Code. 9. That Condition No.2, above-mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. 10. That Condition Nos. 1, 4, 5, 6, 7, and 8, above-mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared inavlid or unen- forceable by the final judgment of any court of competent jurisdic- tion, then this Resolution, and any approvals herein contained, shall be deemed null and void. -,-'- THE FOREGOING RESOLUTION is approved and City Council of the City of Anaheim this 23rd da ed by the ruary, 1982.
