1982-126 RESOLUTION NO. 82R-126 ,~, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A UTILITY EASEMENT SOUTH OF LINCOLN AVENUE AND WEST OF RIO VISTA STREET. WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate cer- tain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 7th day of March, 1982, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not re- served and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of that certain utility easement, more specifically described as follows: Those certain easements for electrical purposes as acquired by the City of Anaheim as successor in inter- est to Southern California Edison Company, in the City of Anaheim, County of Orange, State of California, who acquired title through instruments recorded in Book 224, pages 23 and page 53, both of Deeds, records of said Orange County, said easements more particularly described as follows: ,,,--., -1- 8l-l8A PARCEL 1: .--... -- .". That certain easement for electrical utility purposes in said City of Anaheim as conveyea by deed to said Southern California Edison Company, its successors and assigns as recorded in Book 224, page 23, of Deeds records of said Orange County, granting the right to construct, use, maintain and replace one line of poles upon which to suspend from crossarms, brackets or other appropriate devices to be attached to said poles, wires for conveying electric energy to be used for light, heat, power and other purposes and use the same for such pur- poses. Said poles, wires, and other appurtenances shall be erected, used and maintained upon that portion of real property described as follows; Along a strip of land 5 feet wide, the southerly line of which is the south line of the Southeast quarter of the Northeast quarter of the Southeast quarter, Section 12, Township 4 South, Range lO West, S.B.B. & M., also along a strip of land 10 feet wide, the centerline of which is described as follows: Beginning at a point in the southerly line of the above described property, which point is distant easterly 5.00 feet, more or less, from the southwest corner of said property; thence Northerly parallel to and distant 5.00 feet easterly from the westerly lime of said property, to a point in the northerly line of same. PARCEL 2: That certain easement for electrical utility purposes in said City of Anaheim as conveyed by deed to said Southern California Edison Company, its suc~essors and assigns as recorded in Book 224, page 53, of Oeeds, records of said Orange County granting the right to construct, use, main- tain and replace one line of poles upon which to suspend from crossarms, brackets or other appropriate devices to be attached to said poles, wires for conveying electric energy to be used for light, heat, power or other purposes and use the same for such purposes. Said poles, wires, and other appurtenances shall be erected, used and maintained upon that portion of real property described as follows: ---.. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this reso- lution is recorded in the Office of the Recorder of Orange County. -2- - ","""'" BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange at such time as all of the following condi- tions precedent to said vacation have been fulfilled: .~. 1. Installation of new underground (12KV) electrical service at no cost to City pursuant to City specifications. 2. Grant of easement deed for public utility purposes to accommodate said electrical service.
