A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM APPROVING AN
AMENDMENT TO CERTAIN CONDITIONS OF
APPROVAL IN CONDITIONAL USE PERMIT
NO. 3400 AND AMENDING RESOLUTIONS
NOS. 91R-165 AND 91R-239.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 91R-165 approving Conditional
Use Permit No. 3400, subject to certain conditions specified
therein; and
WHEREAS, certain of said conditions of approval of
Conditional Use Permit No. 3400 were heretofore amended or added
by Resolution No. 91R-239; and
WHEREAS, the permittee has now requested a further
amendment to certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on August 18, 1992, at which hearing the City Council did
receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said Conditional Use Permit.
NOW, THEREFORE, BE IT RESOLVED by the city Council of
the City of Anaheim that the conditions of approval heretofore
imposed in Conditional Use Permit No. 3400 be, and the same are
hereby, amended by the amendment of Conditions Nos. 12 and 25
thereof, as set forth in Resolution No. 91R-165, and as amended
by Resolution No. 91R-239, to read as follows:
"12. That the existing pole sign shall be permitted
together with one additional freestanding sign on
subject property constructed in accordance with
Exhibit A and located in accordance with plans
heretofore submitted to the city Council which
Exhibit and plans are on file in the Planning
Department."
"25. That Condition Nos. 6, and 13, above-mentioned,
shall be complied with on or before April 27,
1993, and Condition No. 14, above mentioned, shall
be complied with on or before October 27, 1992;
provided, however, that prior to October 18, 1992,
security in the form of a bond, certificate of
deposit, letter of credit or cash, in an amount
