1982-258RESOLUTION .NO. 82R -258 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MAKING A FINDING REGARDING THE VALUE OF WRITTEN PROTESTS FILED AND NOT WITH- DRAWN IN ANNEXATION PROCEEDINGS FOR BALL - FREEWAY NO. 3 ANNEXATION AND ORDERING THE TERRITORY ANNEXED PURSUANT TO SECTION 35229 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA. WHEREAS, a petition for the proposed annexation designated Ball- Freeway No. 3 Annexation to the City of .Anaheim in the County of Orange was heretofore filed by the City of Anaheim, as chief petitioner, and accepted for filing on October 5, 1981, by the Executive Officer of Local Agency Formation Commission of Orange County, California (hereinafter "Commission ") pursuant to Part 2 of Title 4, Division 2, commencing with Section 35000 et seq. of the Government Code; and WHEREAS, the distinctive short form designation assigned by the Commission to the territory proposed to be annexed is: BALL - FREEWAY NO. 3 ANNEXATION TO THE CITY OF ANAHEIM; and WHEREAS, said territory proposed to be annexed to the City of Anaheim consists of approximately 34.731 of land in the County of Orange, and the exterior boundaries thereof are speci- fically described in the legal description attached hereto and by this reference made a part hereof; and WHEREAS, the Commission has heretofore determined in its Resolution No. 81 -95, adopted on October 28, 1981, that the terri- tory proposed to be annexed is uninhabited; and WHEREAS, the .City Council of the City of Anaheim has here- tofore adopted its Resolution No. 82R -87 initiating proceedings pursuant to Section 35220 of the Government Code for the annexation of the hereinabove described territory to the City of Anaheim; and WHEREAS, the City Council of the City of .Anaheim conducted a duly noticed public hearing on March 30, 1982, and did hear and receive all oral and written protests, objections, and evidence made, presented or filed in opposition to the proposed annexation of the hereinabove described territory to the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: -1- I. That the City Council does hereby find that the value of written protests filed and not withdrawn by owners of land and im- provements within the territory hereinabove described is less than fifty percent of the total assessed value of land and improvements within said territory. -- 2. That the City Council does hereby order the annexation of the hereinabove described territory to the City of Anaheim pur- suant to Section 35229 of the Government Code of the State of California. 3. That the City Clerk shall file a certified copy of this Resolution with the Executive Officer of the County of Orange Local Agency Formation Commission. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 18th day of May, 1982.
