A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM RESCINDING RESOLUTION NO. 82R -170
AND ADOPTING A NEW RESOLUTION ACCEPTING TWO
EASEMENT DEEDS CONVEYING TO THE CITY OF ANAHEIM
CERTAIN REAL PROPERTY FOR AN EASEMENT FOR ROAD
AND PUBLIC UTILITY PURPOSES. (R /W #2800 -38
AND R/W #2800 -39)
WHEREAS, the City Council of the City of Anaheim did, on
the 30th day of March, 1982, adopt Resolution No. 82 -170 approving
the purchase of certain real property for municipal purposes, to
wit: Easements for road and public utility purposes; and
WHEREAS, through inadvertence and clerical error, said
resolution contained only a partial description of the real prop-
erty; and
WHEREAS, it is necessary to rescind Resolution No. 82R -170
and adopt a new resolution in its place.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Resolution No. 82R -170 be, and it is hereby,
rescinded.
BE IT FURTHER RESOLVED by the City Council of the City
of Anaheim that the offer of JAMES N. WINGERT and DOLORES M. WINGERT
to sell to the City of Anaheim the following described real property
situated in the City of Anaheim, County of Orange, State of California,
to be used for an easement for road and public utility purposes, and
more particularly described as follows:

An easement for road and public utility purposes over,
under and across that portion of the southerly 32 feet
of Lot 4 and of the northerly 18 feet of Lot 5 of Geerdes
Subdivision, as shown on a map recorded in Book 8, page
77, Miscellaneous Maps, records of said Orange County,
described as follows:
Beginning at the centerline intersection of Anaheim
Boulevard and Ellsworth Street; thence S 15 30' 00" E
along said centerline of Anaheim Boulevard, 78.99 feet,
thence N 74 27' 30" E, 44.80 feet; thence N 15 30'
00" W, 35.01 feet to the beginning of a curve concave
southeasterly and having a radius of 15.00 feet; thence
northerly and easterly along said curve through a central
angle of 89° 51' 30" an arc distance of 23.55 feet to
a point in the northerly line of said Lot 4; thence N 15°
32' 30" W, 29.00 feet to a point in the centerline of said
Ellsworth Street; thence S 74 27' 30" W, 59.77 feet
along said centerline to the point of beginning.

An easement for road and public utility purposes over,
under and across the westerly 10.05 feet of the southerly
32.00 feet of Lot 5, and of the northerly 10.00 feet of
Lot 6, of Geerdes Subdivision, as shown on a map recorded
in Book 8, page 77, Miscellaneous Maps, records of said
Orange County,
be, and the same is hereby, accepted by the City Council of the City
of Anaheim, and that the City of Anaheim accent a conveyance of said
property; provided, however, that nothing herein shall be construed
to be an acceptance of any parcel or property into the City street
system (Section 1806, Streets and Highways Code).
BE IT FURTHER RESOLVED that the Accounting Officer of the
City of Anaheim be, and he is hereby, authorized to issue a warrant
and pay to the owners of said real property, out of General Funds
of the City of Anaheim and charged to Account No. 13- 792 - 7101- E2580,
the sum of Eight Thousand One Hundred Dollars ($8,100.00).
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 25th day of May, 1982.
