92-166 RESOLUTION NO. 92R-166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CALIFORNIA~ SETTING PRIORITIES FOR FILING WRITTEN ARGUMENTS REGARDING CITY MEASURES AND DIRECTING THE CITY ATTORNEY TO PREPARE IMPARTIAL ANALYSES. WHEREAS, a General Municipal Election is to be held in the City of Anaheim, California, on November 3, 1992, at which there will be submitted to the voters the following measures: MEASURE NO. 1 CITY COUNCIL TERM LIMITS. Shall Section 503.5 be added to the City Charter generally limiting consecutive years of service by members of the City Council, including the Mayor, to a combined total of two four-year terms? MEASURE NO. 2 UTILITY REVENUE TRANSFER LIMITS. Shall Section 1221 of the city Charter which provides restrictions upon the City Council in establishing water and electric utility rates be amended to provide that not more than 8 percent of the gross revenues earned by each utility during the preceding fiscal year may be paid into the general fund of the city during any fiscal year? MEASURE NO. 3 CLOSED SESSION MEETINGS. TECHNICAL AMENDMENT. Shall Sections 510 and 904 of the City Charter be amended to conform to the requirements of state law concerning the permissible grounds for holding closed session meetings by the City council and its boards and commissions? MEASURE NO. 4 MAXIMUM FINES. TECHNICAL AMENDMENT. Shall Sections 515 and 1501 of the City Charter be amended to increase the maximum fine for Charter or ordinance violations from $500 to $1000 to conform to state law and to allow future fine increases in conformance with state law change? MEASURE NO. 5 PUBLIC CONTRACT BIDDING. TECHNICAL AMENDMENT. Shall Section 1211 of the City Charter be amended to conform certain language £n said section to the provisions of state law relating to the requirement to award certain public works contracts to the lowest responsible bidder? MEASURE NO. 6 CLAIMS AGAINST THE CITY. TECHNICAL AMENDMENT. Shall Section 1217 of the City Charter be amended to conform the time limits within which the City is required to act on claims against the City to the provisions of state law? MEASURE NO. 7 READING OF ORDINANCES AND RESOLUTIONS. TECHNICAL AMENDMENT. Shall Section 511 of the City Charter be amended to authorize the City Council to adopt a single motion at any City Council meeting waiving the oral reading of the complete text of all ordinances and resolutions adopted at such meeting in lieu of the current procedure which requires a separate waiver for each ordinance or resolution? MEASURE NO. 8 ADVISORY VOTE ONLY CAMPAIGN CONTRIBUTION LIMITS. Should the City Council adopt an ordinance limiting the amount of campaign contributions a city candidate may receive from any single source to $1,000 per election? NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Council authorizes MEASURE 1 Favor: Hunter/Daly/Ehrle A§ainst: Pickler MEASURE 2 MEASURE 3 None MEASURE 4 None MEASURE 5 None MEASURE 6 MEASURE 7 None MEASURE 8 Favor: Hunter/Daly/Ehrle A~ainst: Pickler -2- members of that body, to file written argument(s) regarding the City measures as specified above in accordance with Article 4, Chapter 3, Division 5 of the Elections Code of the State of California and to change the argument until and including the date fixed by the City Clerk after which no arguments for or against the City measure may be submitted to the city Clerk. SECTION 2. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney, unless the organization or salaries of the office of the City Attorney are affected. The City Attorney shall prepare impartial analyses of the measures showing the effect of the measures on the existing law and the operation of the measure. If the measure affects the organization or salaries of the office of the City Attorney, the City Clerk shall prepare the impartial analysis. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 3. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED ON JULY 28, 1992.
