1981-429 ,- RESOLUTION NO. ~1R-429 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DET~RMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL conE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHO~Ln BE CHANGED. WHEREAS, the City Planning ~Comrnission of the City of Anaheim did hold a public hearing in ,Reclassification Proceedings No. 80-81-39 to consider an ~endment to Title 18 of the Anaheim MUnicipal Code relating to zqning, and to consider a Change in the boundaries of the zone or zones hereinafter men- tioned and described and, at said he~ring, did receive evidence and reports from persons interested ~herein and from its staff; and WHEREAS, within a period of forty (40) days fOllowing said hearing, the Planning Commission! did duly adopt a resolution containing a report of its findings, ~ summary of the evidence presented at said hearing and approv~ the proposed amendment; and WHEREAS, thereafter, within. the time prescribed by law, an interested party or the City Counc~l, on its own motion, caused the review of said Planning Commissio~ action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly ho~d and conduct such hearing and did give all persons interested t~erein an opportunity to be heard and did receive evidence and reWerts, and did consider the same; and WHEREAS, the City Council dqes find and determine that the amendment to Title 18 of the Anah~im Municipal Code should be adopted and that the property hereina~ter described should be excluded from the zone or zones in wh~ch it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of ~he Anaheim Municipal Code be, and the same is hereby, amended and that the fOllowing de- scribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: - ATTY-18-C 80-81-39 LIlo....... '-~ - ~~ Lots 4 through 19, 19A and Lots 20 through 29 in Tract No. 255, as shown on a map recorded in Book 14, page 25, Miscellaneous Maps, records of Orange County, California. Excepting therefrom any portion thereof lying within Coffman Street and Cypress Street, as shown on the map of said Tract, be reclassified and incorporated in the "RM-2400" RESIDENTIAL, MULTIPLE-FAMILY ZONE of the Ci ty of Anaheim, subject to the following conditions: 1. That the owners of subjecq property shall deed to the City of Anaheim a strip of land 30 'feet in width from the cen- terline of the street along Coffman Street for street widening purposes. 2. That all engineering requirements of the City of Anaheim along Coffman Street includ~ng preparation of improve- ment plans and installation of all. improvements such as curbs and gutters, sidewalks, street gr4ding and paving, drainage facilities or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with specifica- tions on file in the Office of the City Engineer; that street lighting facilities along Coffman Street and Cypress Street shall be installed as required by the Office of Utilities General Manager, and in accordance with specifications on file in the Office of Utilities General Manager; and/or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the Ci ty of Anaheim shall be posted with the City to guarantee the installation of the above- mentioned requirements prior to occupancy. 3. Ci ty of Council, Street. That the owners of subject property shall pay to the Anaheim a fee, in an amount as determined by the City for tree planting purposes along Coffman and Cypress 4. That sidewalks shall be installed along Cypress Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 5. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Executive Director of Public Works. ,..,........... 6. That fire hydrants shall be installed and charged as required and determined to be neces~ary by the Chief of the Fire Department prior to commencement of structural framing. 7. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. -2- ,".......... ..,-"'" 8. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropria~e by the City Council, said fees to be paid at the time the bUilding permit is issued. 9. That the owners of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as determined by the City Council, for each new dwelling unit prior to the issuance of a bUilding permit. lO. That ordinances reclassif~ing the property shall be adopted as each parcel is ready to comply with conditions per- taining to such parcel; provided!, however, that the word "parcel n shall mean presently eXisting parcels of record and any parcel or parcels approved by the Ci ty Council for a lot spl i t. 11. That a modified cUl-de-sac shall be provided at the easterly terminus of Cypress Street subject to the approval of the City Engineer. 12. That the maximum density f~r any development proposal shall be fifteen (15) dwelling units per gross acre. 13. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1, 2 and 3, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and voiQ by action of the Planning Commission unless said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may grant. 14. That Condition Nos. 4, 5, 7 and 11, above-mentioned, shall be complied with prior to final bUilding and zoning in- spections. 15. That prior to the introduction of an ordinance rezon- ing the subject property, the City Council shall conduct a pUblic hearing and such other procedures as required by law to consider the closure of Cypress Street at its westerly terminus. ",,-t,"'''~ BE IT FURTHER RESOLVED thait the Ci ty Council of the City of Anaheim does hereby find and determine that the adop- tion of this Resolution is expressly predicated upon appli- cant's compliance wi th each and all of the condi tions herein- above set forth.
