1981-430 ~, RESOLUTION NO. 81R-430 -""....... A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM REVOKING AND TERMINATING CONDITIONAL USE PERMIT NO. 1535. WHEREAS, on May 12, 197$, the Anaheim City Planning Commission did, by Resolution No. PC75-l02, grant Conditional Use Permi t No. 1535, subject to certain. condi tions therein specified; and WHEREAS, on July 27, 1981,. the Planning Commission held a hearing on said matter and thereljlpon did adopt Resolution No. PC81-158 revoking its approval of Co~ditional Use Permit No. 1535; and WHEREAS, within the time p~ovided by law, said decision was appealed to the City Council of the City of Anaheim; and WHEREAS, on September 8, 1981, the City Council did conduct a duly noticed pUblic hearing pursuant to the provisions of Section 18.03.091 of the Anaheim Municipal Code to determine if the grounds existed under the provisions of Anaheim Municipal Code Section 18.03.092.050 for the termination of Conditional Use Permit No. 1535 for exercising said piermit in a manner detrimental to the pUblic health or safety, or so as to constitute a nuisance; and WHEREAS, after considering all of the evidence and testimony offered at said hear ing, tihe City Counci 1 does hereby find that the permittee has exercisekl Conditional Use Permit No. 1535 in a manner detrimental to the PUblic health or safety; or so as to constitute a nuisance as follows: 1. That evidence presented at the pUblic hearing by Anaheim Police Department staff in the Profil~, dated March 30, 1981, and submitted by the Police Department, reflects an on-going law enforcement problem; said Profile being a cumulative list documenting the efforts of the Vice and Narcotic Detail with assistance from other agencies and divisions (State of California Alcoholic Beverage Control, County of Orange Environmental Health, Patrol Detail, and Zoning DiVision). /"".~ 2. That the owner and operator of the business have failed to exercise and implement reasonable measures to prohibit, curb or otherwise discourage and prevent criminal activities on and about the premises; and 3. That as a result thereof, such business consti tutes a detriment to the pUblic health and safety and is a nuisance.
