1982-306RESOLUTION NO. 82R -306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. �1 -82 - ;0 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and approved the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should he adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following de- scribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: THAT PORTION OF THE EAST HALF OF FRACTIONAL SECTION 3, T 4 SAN JUAN CAJON DE SANTA ANA, ORANGE, STATE OF CALIFORNIA, BY DEED RECORDED IN BOOK 636, OFFICE OF THE COUNTY RECORDER AS FOLLOWS: -1- OF THE NORTHWEST QUARTER S, R 10 W, WITHIN THE RANCHO CITY OF ANAHEIM, COUNTY OF CONVEYED TO HENRY G. MEI SER PAGE 354 OF DEEDS, IN THE OF SAID COUNTY, DESCRIBED 81 -82 -10 ATTY -I8 -C BEGINNING AT THE SOUTHEASTERLY CORNER OF PARCEL 4 OF THE HIGHWAY RIGHT OF WAY RELINQUISHED (REL -254) TO THE CITY OF ANAHEIM BY RESOLUTION OF THE CALIFORNIA HIGHWAY COMMISSION, A CERTIFIED COPY OF WHICH RESOLUTION IS RE- CORDED NOVEMBER 30, 1965 IN BOOK 7756, PAGE 472 OF OFFICIAL RECORDS, IN SAID OFFICE; THENCE NORTHERLY ALONG THE EASTERLY LINE OF SAID PARCEL 4 DESCRIBED THEREIN AS N 1 36' 48" E, 141.69 FEET TO THE NORTHERLY TERMINUS OF SAID COURSE SO DESCRIBED: THENCE S 89 36' 00" E, 322.00 FEET; THENCE S 40 56' 24" E, 33.03 FEET; THENCE S 7 43' 07" W, 90.40 FEET; THENCE S 58 28' 27" W, 75.96 FEET TO THE SOUTHERLY LINE OF SAID LAND OF MEISER; THENCE N 86 51' 29" W, 271.14 FEET TO THE POINT OF BEGINNING, be incorporated in the ML (Industrial, Limited) Zone of the City of .Anaheim, subject to the following: 1. That all engineering requirements of the City of Anaheim along Lemon Street including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the City Engineer; that street lighting facilities along Lemon Street shall be installed as required by the Office of Utilities General Manager, and in accordance with specifications on file in the Office of Utilities General Manager; and /or that a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the instal- lation of the above - mentioned requirements prior to occupancy. 2. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 3. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. IWM 7. That the owners of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as deter- mined by the City Council for industrial buildings prior to the issuance of a building permit. 8. That the owner shall prepare, execute and record a coven- ant against the property in a form approved by the City Attorney and City Engineer, whereby the owner will landscape and maintain the City -owned property behind (east of) the future curb along Lemon Street at no cost to the city. 9. That owner of subject property shall enter into an agree- ment with the City of Anaheim to install a traffic signal at the intersection of Lemon Street and the Riverside Freeway on -off ramp in conformance with State of California, City of Anaheim, and City of Fullerton standards with separate phasing and vehicles indica- tions. Said signal shall be required to be installed if traffic volume exceeds 200 vehicle trips per average work day. Said agree- ment shall be submitted to the City Traffic Engineer and City Attorney for review and approval. 10. That the proposed driveway from Lemon Street shall have a maximum grade of 2% for a distance of 40 feet from the back (east) of the sidewalk adjacent to said street. 11. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of .Anaheim marked Exhibit Nos. 1 and 2. 12. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1, 8, and 9, above- mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission un- less said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may grant. 13. That Condition Nos. 2, 4, 5, 10 and 11, above - mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unen- forceable by the final judgment of any court of competent juris- diction, then this Resolution, and any approvals herein contained, shall be deemed null and void. -3- THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 8th day of June, 1982.
