1982-313RESOLUTION NO. 82R -313 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE BAUER RANCH GENERAL PLAN OF DEVELOPMENT AND AMENDING THE CONDITIONS OF APPROVAL AS SET FORTH IN RESOLUTION NO. 79R -607. WHEREAS, the City Council of the City of Anaheim adopted Resolution No. 79R -50 on January 23, 1979, in Zoning Reclassification Proceedings No. 77- 78 -64, finding and determining that Title 18 of the Anaheim Municipal Code relating to zoning boundaries should be amended and that the boundaries of certain zones should be changed, subject to certain conditions of approval contained therein; and WHEREAS, said Resolution No. 79R -50 was subsequently amended by Resolution No. 79R -607 and 80R -481; and WHEREAS, the Planning Commission of the City of Anaheim has heretofore determined that the public necessity, convenience and general welfare require the further amendment of the conditions of approval of said Resolution No. 79R -607 and has recommended such amendment to the City Council; and WHEREAS, the City Council has heretofore held a duly noticed public hearing to consider said amendment of conditions and did give all persons interested therein an opportunity to be heard and did receive reports and evidence, and did consider the same; and WHEREAS, the City Council does find and determine that the public necessity, convenience and general welfare require that the conditions of approval of said Resolution No. 79R -607 be amended in the manner hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Conditions Number 21 and 22 as set forth in Resolution No. 79R -607 (amending Resolution No. 79R -50) relating to Zoning Reclassification Proceedings No. 77 -78 -64 be, and the same are hereby, amended, respectively, to read as follows: "21. That prior to the introduction of the first ordinance to establish zoning on any parcel(s) excepting commercial parcels within the Bauer Ranch Planned Community a revised specific public facilities plan addressing Revision No. 3a of Exhibit No. 1 of the Bauer Ranch General Plan of Development including such implementation programs as may be approved by City Council, shall be provided by the developers of the entire Planned Community (Kaufman and Broad, Inc. or their successors, assignees, or transferees). The specific plan shall include, but not be limited to, a discussion and evaluation of the following: -1- a. Identification of all the public facilities proposed for the area including, but not limited to, public streets, landscaped medians and parkways; public parks and open spaces; police and fire facilities; libraries; equestrian and hiking trails, bicycle lanes, electric utilities such as substations, transmission lines, and street lighting; and water utilities such as transmission mains and reservoirs. b. Ultimate development capacities of the public facilities for the area. C. Land proposed to be reserved for public facilities purposes. d. Cost to the City of Anaheim for all public facilities. e. Alignment, phasing and bonding for: all rights -of -way for all scenic expressways and arterial highways including equestrian and hiking trails and bicycle lanes; storm drains; utility easements and other public facilities. f. Specific means of financing the installation, construction, and maintenance of all public facilities; such means may include, but are not limited to, reimbursement districts, assessment districts, in -lieu fees, establishment of a master homeowners association, etc.; provided that the specific means for each public facility shall be approved by the City of Anaheim. "22. That subject property shall be developed substantially in accordance with the Bauer Ranch General Plan of Development on file with the City of Anaheim and marked Revision No. 3a of Exhibit No. 1; provided, however, that the total dwelling unit count shall not exceed 945, although transfer of units between land use areas may be approved by the Planning Commission following submittal of precise plans for each transfer, in the preceding Condition No. 3." BE IT FURTHER RESOLVED that, except as herein expressly amended, Resolution No. 79R -607 as heretofore amended shall remain in full force and effect. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. -2- THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 8th day of June, 1982.
