1982-335RESOLUTION NO. 82R -335 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO AMEND ORDINANCE NO. 4087 GRANTING STORER CABLE T.V., INC., THE NONEXCLUSIVE RIGHT, PRIVILEGE AND FRANCHISE FOR THE INSTALLATION AND OPERATION OF A CABLE TELEVISION COMMUNICATION SYSTEM IN THE CITY OF ANAHEIM. WHEREAS, the City Council did, on the 26th day of December, 1979, adopt Ordinance No. 4087 granting Storer Cable T.V., Inc. a nonexclusive cable communication franchise ordinance; and WHEREAS, the City Council does deem it necessary to amend said ordinance; and WHEREAS, Section 1401 of the charter of the City of Anaheim requires that the City Council pass a resolution to declare its intent to amend said franchise. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby declare its intention to amend Ordinance No. 4087 granting to Storer Cable T.V., Inc. the nonexclusive right to install a cable communication system pursuant to the provisions of Ordinance No. 4087 within the City of Anaheim. AND, BE IT FURTHER RESOLVED that the City Council does hereby fix the 27th day of July , 1982, and the hour as 3:00 p.m., and the place at the City Council Chambers in the Civic Center of the City of Anaheim, as the place in and where any persons having any interest or objections to the amendment of Ordinance No. 4087 pertaining to cable communication service in the City of Anaheim, to appear and be heard thereon. BE IT FURTHER RESOLVED that the City Clerk shall publish this resolution once within fifteen days of the passage thereof in the official newspaper of the City of Anaheim. BE IT FURTHER RESOLVED that the City Council does hereby declare that it does propose to amend said franchise upon the following terms, conditions and in the form as follows: oc "ORDINANCE NO. AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING ORDINANCE NO. 4087 PERTAINING TO CABLE COMMUNICATION SERVICE IN THE CITY OF ANAHEIM. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: That Section 5 of Exhibit "A" is hereby amended to read as follows: Storer Cable T.V. Inc. proposes the following rates and charges: INSTALLATION - RESIDENTIAL CUSTOMERS Primary Installation - Aerial Primary Installation - Underground $15.00 $25.00 Primary installation includes up to two (2) outlets at this charge: Additional Outlet Relocate Outlet Reconnect Service Premium Service $ 5.00 $ 5.00 $10.00 $29.95 Customer subscribing to a premium service at the time of initial installation would pay only the $29.95 charge. The cable installation charge would be waived. Free installation to all within the first thirty days service is available to a home. MONTHLY SERVICE RATES - RESIDENTIAL CUSTOMERS Primary Outlet $ 6.00 Additional Outlet $ 1.50 FM Outlet $ 1.50 Showtime Premium Service $ 7.50 Home Box Office Premium Service $ 7.50 HBO Take -Two $ 4.95 Converter Rental -Per Outlet $ 1.50 A wireless remote converter $ 3.00 Hand -held remote control -a purchase charge $25.00 (including a one -year guarantee for parts and labor on said unit) -2- COMMERCIAL INSTALLATION Billed on a time and materials basis MONTHLY SERVICE RATES - COMMERCIAL (Bulk Billing) Same rates for primary and additional outlets with a 20% discount for bulk billing if wiring done by Storer. If using acceptable master antenna, per wiring, rates would be negotiated. SPECIAL FEATURES We offer one free month of service when the subscriber pays eleven (11) months in advance. This represents a savings of 8 1 /3%. Parental control key device available for premium channels at our cost (approximately $10.00), and would be repurchased by the Company at time of disconnect. No deposit required for converters to residential customers. It is Storer's policy to offer special non - discriminatory special promotions during the life of the franchise. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 3. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 4. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
