1982-372RESOLUTION NO. 82R -372 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R -600 AND MOST RECENTLY AMENDED BY CITY COUNCIL RESOLUTION NO. 81R -402. WHEREAS, the City distribution system for the and inhabitants of the City Rates, Rules and Regulations of water; and of Anaheim maintains a water furnishing of water to residents of Anaheim and has adopted Water for the sale and distribution WHEREAS, the Customer Service Division of the Public Utilities Department bills for sanitation services including street cleaning, sewer system maintenance and solid waste collection for the City of Anaheim; and WHEREAS, the Public has recommended amending Rules Rates, Rules and Regulations to in said Rules and to authorize credit balance in the event of Utilities General Manager 10 and 17 of said Water include sanitation charges the Utility to refund a a Utility error. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Water Rates, Rules and Regulations adopted by City Council Resolution No. 72R -600 and most recently amended by City Council Resolution No. 81R -402 be amended as follows, to wit; CITY OF ANAHEIM Water Utility Post Office Box 3222 Anaheim, California 92803 Page No. 3.10.1 RULE NO. 10 DIS "PUTED BILLS A. When a customer and the Utility fail to agree on a bill for water or sanitation services: The customer may, in lieu of paying the disputed bill, deposit with the Utilities General Manager of the City of Anaheim the amount claimed by the Utility to be due. Upon receipt of the deposit, the Utilities General Manager will review the basis of the billed amount, communicate the results of his review to the customer and make disbursement of the deposit. B. Service will not be discontinued for nonpayment of the disputed bill when deposit has been made with the Utilities General Manager pending the outcome of the review. C. Failure of the customer to make such deposit within fifteen days after receipt of the bill will constitute acceptance by the customer of the bill as rendered, and warrant discontinuance of his service in accordance with Rule No. 11. D. If before completion of the Utilities General Manager's review, additional bills become due which the customer wishes to dispute, he shall also deposit with the Utilities General Manager the additional amounts claimed by the Utility to be due for such bills before they become past due and that failure to do so will warrant discontinuance of his service in accordance with Rule No. 11. E. If the bill is not satisfactorily resolved with the Utilities General Manager, the customer may petition the City Council for final determination. Failure of the customer to petition the City Council for final deter- mination within fifteen days after receipt of the Utilities General Manager's findings, will constitute acceptance by the customer of the findings. When it is found that the error in a meter is due to causes, the date of which can be reliably esta- blished, the overcharge or the undercharge may be computed back to that date, provided, however, that in no case will a bill for an undercharge exceed a four (4) month period for single- family residential service schedules or a twenty -four (24) month period for all other service schedules. C. ADJUSTMENT OF BILLS FOR UTILITY ERROR 1. General. When it is found that an error in billing has occurred due to a Utility error for water or sanitation services, the date of which can be reliably established, the overcharge or the undercharge may be computed back to that date, provided, however, that in no case will a bill for an undercharge exceed a four (4) month period for single- family residential service schedules or a twenty -four (24) month period for all other service schedules. 2.
