1981-273RESOLUTION NO. 81R-273 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN SAID CITY ON JUNE 2, 1981, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS PROVIDED BY THE PROVISIONS OF THE CHARTER. WHEREAS, a special municipal election was held and con- ducted in the City of Anaheim, California, on Tuesday, June 2, 1981, as required by the Charter; and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and con- ducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California f_or the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 81R-140 adopted March 24, 1981, the City Clerk of_ said City canvassed the returns of said election and has certified the results to this City Council, said results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That there were 76 voting p ecincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in said City as established for the holding of state and county elections. SECTION 2. That at said special municipal election, the following measures were submitted to the electors of said City, to wit PROPOSITION A In order to obtain substantial savings and provide more economical electric service, shall the City of Anaheim be authorized to finance the construction ,,~,, and acquisition of_ facilities, property and rights related to the San Onofre Nuclear Generating Station and the generation and transmission of electric energy by issuing revenue bonds and rev- enue bond anticipation notes and any combination thereof, not payable from property taxes, in an aggregate principal amount outstanding in accord- ance with their terms at any one time not to exceed $92 million? -1- PROPOSITION B Shall the Charter of the City of Anaheim be amended to permit the issuance by the City of electric and water refunding revenue bonds to purchase, redeem or retire electric and water revenue bonds without additional authorization by the voters, when the City Council determines that the issuance of such refunding bonds will reduce costs to the City or will otherwise be financially advantageous to the City, provided that any principal and interest sav- ings from any such refunding in any year shall be reflected in establishing utility rates? SECTION 3. That the whole number of votes cast in said City (except absent vote ballots) was 6,019. That the whole number of absent vote ballots cast in said City was 269, making a total of 6,288. SECTION 4. That the returns of said election have been duly and regularly canvassed by the City Clerk of the City of Anaheim as provided by law, and all absentee ballots, if any, returned have been canvassed as provided by law. SECTION 5. The total votes cast at said election for and against said propositions and upon said propositions are all as shown on the City Clerk's Certificate of Canvass, attached hereto as "Exhibit A." SECTION 6. That the votes of more than fifty percent of all the voters voting at said election upon Proposition A and Proposition B were cast in favor of the adoption of said Proposition A and Proposition B and said Proposition A and said Proposition B are hereby declared to have carried at said election. SECTION 7. The City Clerk shall enter on the records of the City Council of said City, a statement of the result of said election, showing: (1) The whole number of votes cast in the City. (2) The measures voted upon. (3) The number of votes given at each precinct for and against each measure. (4) The number of votes given in the City for and against each measure. -2- SECTION 8. That the City Clerk shall certify to th e passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the `"`"° proceedings of the City Council of said City, in the minutes of the meting at which the same was passed and adopted.
