A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM CONSENTING TO THE APPROVAL BY THE
ANAHEIM REDEVELOPMENT AGENCY OF AN OWNER
PARTICIPATION AGREEMENT BETWEEN THE ANAHEIM
REDEVELOPMENT AGENCY AND THE CALIFORNIA STATE
TEACHERS RETIREMENT SYSTEM, APPROVING THE
PROVISION OF PUBLIC IMPROVEMENTS AND MAKING
CERTAIN FINDINGS IN CONNECTION THEREWITH
WHEREAS, the Anaheim Redevelopment Agency (hereinafter
referred to as the "Agency") under the provisions of the California
Community Redevelopment Law, is engaged in activities necessary for
the execution of the Redevelopment Plan for the Plaza Redevelopment
Project (hereinafter referred to as the "Project Area"); and
WHEREAS, the Agency has certified a Supplemental Environmental
Impact Report ("Supplemental EIR") and approved execution of an
Owner Participation Agreement ("OPA") with the California State
Teachers Retirement System (the "Participant") for development of
a promotional retail/service pedestrian shopping center on certain
real property (the "Site") located within the boundaries of the
Project Area; and
WHEREAS, pursuant to the OPA, the Agency will be responsible
for a portion of the costs of certain public improvements to be
constructed and installed in connection with the development of the
Site (the "Public Improvements"); and
WHEREAS, pursuant to Section 33445 of the Community
Redevelopment Law, the Agency is authorized with the consent of the
City Council to be responsible for all or any part of the value of
and the cost of installation and construction of any building,
facility, structure or other improvement which is publicly owned
either within or without the Project Area upon a determination by
the city Council that such building, facility, structure or other
improvement is of benefit to the Project Area or the immediate area
in which the Project Area is located and that no other reasonable
means of financing such building, facility, structure or other
improvement is available to the community; and
WHEREAS, the Agency and the city Council have duly considered
all terms and conditions of the proposed OPA and believe that the
development of the Site pursuant to the subject OPA is in the best
interests of the city and health, safety and welfare of its
residents and in accord with the public purposes and provisions of
applicable State and local law requirements;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
RESOLVE AS FOLLOWS:
Section 1: Based upon analysis and information provided by
the Agency, its staff and consultants, and the Participant, and
other information in the record, the city Council finds and
determines that: (i) the provision of the Public Improvements is of
benefit to the Project Area and the neighborhood in which such
Public Improvements are to be situated; and (ii) no other
reasonable means of financing the Public Improvements are available
to the community.
Section 2: The City Council has considered the environmental
effects of the Project as shown in the Supplemental Environmental
Impact Report certified by the Agency and hereby adopts the
environmental findings set forth in Exhibit "A" to this Resolution.
Section 3: The City Council approves the provision of the
Public Improvements by the Agency pursuant to the terms of the OPA.
The City Council consents to and approves execution of the OPA by
the Agency, and the provision of the Public Improvements by the
Agency pursuant to the terms of the OPA.
