A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING COUNCIL POLICY NO. 107
_-, AND RESCINDING RESOLUTION NO. $OR-379 RELATING
TO PROCEDURES FOR THE USE, DUPLICATION AND
TRANSCRIPTION OF TAPE RECORDINGS OF PUBLIC
MEETINGS.
WHEREAS, the City Council has heretofore adopted
Resolution No. 80R-379 amending Council Policy No. 107 relating
to the use, transcription, duplication and destruction of tape
recordings of public meetings of the City Council; and
WHEREAS, the City Council desires to revise said
procedures and policies in the manner hereinafter set :Forth; and
WHEREAS, the City Council further desires that said
procedures and policies be applicable to tape recordings made by
the City staff of any public meetings of the City Council and any
other commissions and boards of the City of Anaheim.
NOW, THEREORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Council Policy No. 107 be, and the same
is hereby, amended to read in its entirety as follows;
"The city clerk, or the secretary of any city
commission or board, shall, upon request, provide to
any member of the public a duplicate copy of any such
tape recording of any public session of any City
Council, city commission or board meeting provided
the request therefor is accompanied by the payment of
the anticipated cost of duplication as estimated by
the city clerk or secretary, including an estimate of
city staff time and costs (including employee benefit
burdens). Any additional amount due, or refund, shall
be paid at the time of delivery of such duplicate .re-
cording to said member of the public.
Except as hereinafter expressly provided, nothing
contained herein shall authorize or require the city
clerk or secretary to prepare a written verbatim trans-
scription of the contents of any such tape recording
or any portion thereof. The city clerk, or the secre-
tary of any city commission or board, shall prepare a
written verbatim transcription of the contents of_ the
~~ tape recording of_ any such meeting, or any portion
thereof, when requested to do so by a duly approved
motion of the City Council, city commission or board.

A written verbatim transcription of the contents
of the tape recording of any public session of a meeting
of the City Council or any city commission or board, or
any portion thereof, shall, upon request, be prepared
and provided to any member of the public under the fol-
lowing circumstances only:
1. Where a transcript of the proceedings is-
required to be prepared by the City pursuant to statute
or court order in connection-with any pending judicial
proceedings; and -
2. Where the request therefor is accompanied by
the payment of the anticipated cost of transcription as
estimated by the city clerk or secretary, including an
estimate of reporter's fees and city staff time and
costs (including employee benefit burdens). Any addi-
tional amount due, or refund, shall be paid at the time
of delivery of such transcription to said member of the
public. A copy of said transcription shall be furnished
to the city clerk or secretary of-such commission or
board without charge. -
The city clerk or secretary of any city commission
or board is hereby authorized ~o retain the services
of a certified shorthand reporter to prepare such
written verbatim transcriptions."
BE IT FURTHER RESOLVED that Resolution No. $OR-379 be,
and the same is hereby, rescinded.
THE FOREGOING RESOLUTION is adopted and approved by the
