1981-358RESOLUTION NO. 81R-358 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, REQUESTING THE COM- MENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATF,D AS LA PALMA-LAKEVIE6V NO. 5 ANNEXATION. WHEREAS, the City of Anaheim desires to annex into its boundaries certain unincorporated and uninhabited territory as here- inafter described; and WHEREAS, said City desires to extend the full range of municipal services to said territory in order to better serve the needs of said property, its owners and inhabitants and WHEREAS, said City desires this resolution to be deemed a resolution of application proposing a change of organization pur- suant to Sections 35140 and 35110 of the Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. That the within proposal is made pursuant to the Municipal Organization Act of 1977 as set .forth in Title 4, Division 2, Part 2 of the Government Code of the State of California. 2. That the nature of the proposed change of organization is for the annexation of the hereinafter described 18.0434 acres of unincorporated and uninhabited territory to the City of Anaheim. 3. That said unincorporated and uninhabited territory be, and the same is hereby, designated as "La Palma-Lakeview No. 5 Annexation to the City of Anaheim," and the boundaries of said affected territory are legally described as follows: That certain parcel of land located in the County of Orange, State of California, described as follows: Beginning in the northeast corner of the Sylvania Annexation to the City of Anaheim, said point of begin- ning being a point in the southerly right of way line of La Palma Avenue 106 feet wide distant N 89° 48' 10" E, 2,780 feet, more or less, from the intersection of said southerly right of way line with the centerline of Lakeview Avenue; thence leaving said annexation boundary and following along a portion of_ the southerly right of way line of said La Palma Avenue N 89° 48' 10" E, 587.76 feet to the beginning of a tangent curve con- cave northerly and having a radius of 2,053 feet, a -1- radial line bearing S 00° 12' 50" E; thence Northeast- erly along said curve through a central angle of_ 08° 11' 02" an arc distance of 293.24 feet to an intersec- tion with the westerly annexation boundary line of the ..~.. East La Palma Annexation to the City of Anaheim, a radial line bearing S 08° 23' S2" E passes through said point of intersection; thence leaving the southerly right of way line of said La Palma .Avenue and following along the westerly annexation boundary line of said East Tea Palma Annexation S Ol° 21' 32" W, 536.94 feet; thence N 88° 47' 16" W, 25.00 feet; thence S Ol° 02' 44" W, 311 feet to the southwesterly corner of the last men- tioned annexation boundary .line, said southwesterly cor- ner also being a point in the southerly line o.f the land described in the deed recorded in Book 10409, page 438, Official Records of Orange County, California; thence leaving the last mentioned annexation boundary line and following along the last mentioned southerly line S $1° 42' 00" W, 433.77 feet to the southwesterly corner of the parcel described in the last mentioned deed, said southwesterly corner also being the southeasterly corner of the land described in the deed recorded in Book 7792, page 153, Official Records of Orange County; thence following along a portion of the boundary of the land described in the last mentioned deed S 81° 55' 05" W, 178.66 feet; thence N 81° 29' 00" W, 671.90 feet; thence N 00° 50' 11" E, 50.45 feet to an intersection with the southerly annexation boundary line of the aforementioned Sylvannia Annexation to the City of Anaheim; thence fol- lowing along a portion of the southerly line and the easterly line of said Sylvannia Annexation the following courses and distances S 81° 27' 52" E, 441.80 feet; thence N 00° 11' 50" W, 825.66 feet to the point of beginning. A map showing the aforesaid boundaries and designated "La Palma- Lakeview No. 5 Annexation" is submitted concurrently with and accompanies this Resolution. 4. That the reasons for the proposed change of organization are as follows: a. Requests by the owners of said unincorporated terri- tory for annexation to the City of Anaheim; and b. To provide full municipal services to an unincor- porated area proposed for industrial development. 5. That the City of Anaheim is hereby designated as the chief petitioner with regard to this application and the mailing address of said petitioner is as follows: -2- City of Anaheim c/o Planning Director P. O. Box 3222 Anaheim, California 92803 6. That the City of Anaheim does hereby request that annexation proceedings be taken and commenced for a change of organization in connection with the hereinabove described unin- corporated territory pursuant to the provisions of said Municipal Organization Act of 1977. 7. That, pursuant to the provisions of Paragraph 6(a)(2) of that certain Master Property Tax Transfer Agreement between the County of Orange and the City of Anaheim dated October 28, 1980 ("Agreement"), the County Administrative Officer and the City Manager or their designees, have heretofore agreed in writ- ing that said territory to be annexed to the City of Anaheim shall be deemed and treated as "undeveloped" property for pur- poses of said Agreement.
