A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEII~1 GF.ANTIP~IG, IN PAF.T, VARIANCE X10.
3227.
WHEREAS, after a request for variance by NORTH ANIEF,ICAI~T
INVESTMENTS, owner; MITCHCO IiVDUSTRIES, agent, was received a
public hearing before the Planning Commission of the City of
Anaheim was held upon due and proper notice, a result of wYiich
Variance No. 3227 was granted covering the following described
property:
PARCELS 1 TO 4 INCLUSIVE, IN THE CITY OF ANA~~EIP~~~,
COUNTY OF ORANGE, STATE OF CALIFORNIA AS PEF. MAP
FILED IN BOOK 148 PAGES 8 AND 9 OF PAF.CEL T~TAPS ,
IN THE OFFICE OF THE COUNTY RECORDER OF SAID
COUNTY.
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion,
caused the review of said Planning Commission action at a public
hearing noticed and held as prescribed by law and, as a result
thereof, the City Council does hereby make the following findings:
1. That there are special circumstances applicable to tine
property, including size, shape, topography, location or surround-
ings, which do not apply to other property under identical zoning
classification in the vicinity.
2. That, because of special circumstances shown in (1)
above, strict application of the zoning code deprives the property
of privileges enjoyed by other property under identical zoning
classification in the vicinity.
NOGG, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that a conditional zoning variance be, and
the same is hereby, granted permitting a freestanding sign of a
maximum height of 25 feet on the property hereinbefore described
with waivers of the following sections of the Anaheim Municipal
Code:
SECTION 18.05.093.023 Permitted location. (240 feet
from west property line re-
quired; 232 feet proposed)
That said variance be granted subject to the following conditions:
1. That subject property shall be developed substantially
in accordance with plans and specifications on file with the City
of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that
the height of said sign shall be reduced to 25 feet.
2. That the owner of subject property shall submit a
letter requesting the termination of Conditional Use Permit No.
216 to the Planning Department.
3. That Condition No. 2, above-mentioned, shall be
complied with prior to the commencement of the activity auth-
orized under this resolution, or prior to the time that the
building permit is issued, or within a period of one year from
date hereof, whichever occurs first, or such further time as
the Planning Commission may grant.
4. That Condition No. 1, above-mentioned, shall be
complied with prior to final building and zoning inspections.
BE IT FURTHER RESOLVED that the City Council does
hereby find and determine that adoption of this Resolution is
expressly predicated upon applicants' compliance with each and
all of the conditions hereinabove set forth. Should any such
conditions, or any part thereof, be declared invalid or unen-
forceable by the final judgment of any court of competent
jurisdiction, then this Resolution, and any approvals herein
contained, shall be deemed null and void,
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owner, its successors or assigns, to
comply with the Anaheim Municipal Code and regulations and the
conditions herein. Said variance is granted for the term pres-
scribed by the Anaheim Municipal Code unless otherwise specifieu
herein.
THE FOREGOING RE50LUTION is approved and adopted by
the City Council of the City o.f Anaheim this 4th day of August,
1981.
