1981-003RESOLi1TI0N NO. 81R- 3 A RESOLUTION OF THE CITY COIJNCIL OF THE CITY OF ANAHEIM DENYING CONnITIONAL USE PERMIT N0. 216 . WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from JOHN AZIZIAN and DEANNE AZIZIAN, owners, and MELVINA A. TRENHOLM, agent, to permit an adult entertainment business (massage parlor) on certain real property located in the City of Anaheim, County of Orange, State of California, described as: PARCEL l: THE NORTH 70 FEET OF THE SOUTH lII0.00 FEET OF THE EAST 390.82 FEET OF THAT PORTION OF SECTION 18, IN TOWNSHIP 4 SOUTH, RANGE 10 WEST, IN THE RANCHO LOS COYOTES, CITY OF ANAHEIM, AS SAID SECTION IS SHOWPd ON A MAP THEREOF RECORDED IV BOOK 51, PAGE 10 OF MISCELLANEOUS MAPS, RE- CORDS OF SAID ORAI~tGE COUi~1TY, DESCRIBED AS FOLLOT~^TS: BEGINNING AT A POIi~1T ON THE EAST LINE OF SAID SECTION 18, NORTH 50.00 CHAINS FROP~I THE SOU^iH- EAST CORNER OF SAID SECTION; THENCE WEST 8.77 CHAINS; THENCE NORTH 11.41 CHP.INS; THENCE EAST 8.77 CHAINS; THENCE SOUTH 11.41 CHAINS TO THE POINT OF BEGINNIi~1G . -1- ATTY--58 (Page 1 of 2 Pages) 1dHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of_ Title 13, Chapter 18.03 of the Anaheim Municipal Code; and ,.~--~ WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC80-202, denying Conditional Use Permit No. 2136; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all z~ersons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and TaHEREAS, the City Council does find, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that a conditional use permit cannot be legally granted for the proposed location since said location does not meet the requirements of Section 18.89.030 of the Anaheim P~Zunicipal Code and further that all of the conditions and criteria set forth in Section 18.03.030.030 of the Anaheim Municipal Code are not present and, therefore, that Conditional Use Permit No. 2136 should be denied. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the Cit~,~ Planning Commission denying Conditional Use Permit Tdo. 2136 be, and the same is hereby, affirmed, and that the reauest of JOHN AZIZIATd and DEANNE AZIZIAN, owners, and MELVINA A. TRENHOLM, agent, to z~ermi.t an adult entertainment business (massage parlor) on the hereinabove des- cribed property be, and the same is hereby, denied.
