1981-018RESOLUTION N0.81R-18 A RESOLUTION OF TFiE CITY COiJNCIL OF THE CITY OF ANAHEIM DENYING CONnITIONAL USE PERMIT NO. 2122 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from LEWIS L. WRIGHT JR., et al., owners, and RICHARD L. FORD, agent, to permit a one-lot 156 unit condominium conversion project with waivers of the following provisions of the Anaheim Municipal Code: SECTION 18.31.061.012 - Minimum lot area per dwelling unit. (3000 sq. ft. required; 1531 sq. ft. existing) SECTION 18.31.062.012 - Maximum structural height. (1 story permitted within 150 feet of RS-A-43,000 zoning; 2 stories existing) SECTION 18.31.062.020 - Maximum site coverage. SECTION 18.31.062.0321 - Minimum floor area. (750 sq. ft. per one-bedroom unit required; 714 sq. ft. existing) SECTION 18.31.063.031 - Minimum recreational-leisure area. ( 1000 sq. ft. per unit required; 649 sq. ft. existing) SECTION 18.31.066.010 - Minimum number and type of parking spaces. (546 spaces - 312 enclosed in a garage required; 279 spaces - 212 in carports existing) on certain property located in the City of Anaheim, County of Orange, State of California, legally described as: That portion of Lots 6 and 7, of the South Placentia Tract No. 1, in the City of Anaheim, as shown on a map recorded in Book 5, Page 42, Miscellaneous Maps, records of said Orange County, lying South of a line parallel with and distant North 833.52 feet, from the South lines of said lots. EXCEPTING THEREFROM that portion of said land, Lying within the following described lines: Beginning at the intersection of the center lines of Sunkist Street and La Palma Avenue as said intersection is shown on map of Tract No. 3614, recorded in Book 152, Pages 42 to 44 in- clusive, Miscellaneous Maps, records of said Orange County; thence along said center line of La Palma Avenue, South 89° 14' 41" East, 1138.45 feet; thence North 0° 45' 19" ATTY-58 (Page 1 of 2 Pages) - ~-- East 50. ~""~` feet to a curve concave Tn" ~erly having a radius of 1500.1,_ feet; thence along said curve Northerly, from a tangent which bears North 9° 56' 44" West, through an angle of 03° 54' 43" an arc distance of 102.41 feet to the Easterly line of said Lot 6 and the true point of beginning; thence continuing along said curve Northwesterly, through an angle of 15° 17' 22" an arc distance of 400.28 feet; thence tangent to said curve, North 29° 08' 49" West 362.51 feet to a line 833.52 feet North of and parallel with the South line of said South Placentia Tract No. l; thence along said parallel line, South 89° 14' 41" East 325.67 feet to said Easterly line of Lot 6; thence along said East- erly line South 0° I4' 05" West 683.64 feet to the true point of beginning; and WHEREAS, the City Planning Commission did hold a public hearing upon said an_plication at the City Mall in the City of Anaheim, notices of which public hearing were duly given as re~ quired by law and the provisions of Title l8, Chapter 18.03 of the Anaheim tunicipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC80-210 . arantinc,L, in p~3rt, Conditional Use Permit No. 2122 ; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and " WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and t^~HEREAS, the City Council does find, after careful con- sideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that all of the conditions and criteria set forth in Sections 18.03.030.030 and 18.03.040.0'0 of the.Anaheim Municipal Code are not present and, the"refore, that Conditional Use Permit No. X122 should be denied. NOW, ~IiEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission granting, in part , Conditional Use Permit No. 2122 be, and the same is hereby, reversed , and that the request of ]'~EWIS L. WRIGHT, JR., et a ., owners an ~ICHnRD L.
