1981-041RESOLUTION N0. 81R-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 3176. WHEREAS, after a request for variance by BILL J. NICREL, ET AL., owners, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3176 was granted covering the following described property: Parcel 1: That portion of lot 6 in Kellogg Homestead Tract, West Anaheim, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 8, page 51 of Miscellaneous Maps, records of Orange County, California, described as follows: Begin- ning at the northeast corner of said lot 6, thence southerly along the easterly line of said lot 6, 220.00 feet to the true point of beginning of this description; thence north 89° 40' west, parallel with the north line of said lot 6, 190.00 feet; thence south 1° 07' 40" west parallel with the east line of said lot 6, 115.00 feet; thence south 89° 40' east, parallel with the north line of said lot 6, 190.00 feet to the east line of said lot 6; thence north 1° 07' 40" east 115.00 feet to the true point of beginning of this description; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances showin in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same ~.. is hereby, granted permitting construction of a 14-unit apartment complex on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: -1- SECTION 18.34.061.010 - Minimum lot area per dwelling unit. (1200 square feet re- quired; 1045 square feet proposed) SECTION 18.34.062.012 - Maximum structural height. (1-story permitted within 150 feet of RS-A-43,000 zoning; 2 stories proposed at 20 feet) SECTION 18.34.065.010 - Minimum distance between buildings. (33 feet required; 21 feet proposed) That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 80-81-17, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 1 of Exhibit Nos. 1, 2 and 3, and Exhibit No. 4. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 3rd day of February, 1981.
