WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from CALIFORNIA CASTLES, INC., owner; KEYSTONE DESIGN ASSOCIATED, agent, to permit a 73-unit motel on certain real property located in the City of Anaheim, County of Orange, State of California, legally described as: THAT PORTION OF THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 4 WEST, IN THE RANCHO LOS COYOTES, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 51, PAGE 11 OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF LOT 162 OF TRACT NO. 2228, AS PER MAP RECORDED IN BOOK 69, PAGES. 34-37 INCLUSIVE OF SAID MISCELLANEOUS MAPS, THENCE SOUTH 89° 59' 32" WEST 382.07 FEET TO THE TRUE POINT OF BEGINNING; THENCE NORTH 0° 10' 30" EAST 95.00 FEET, THENCE SOUTH 89° 59' 37" WEST 190.00 FEET TO THE EAST LINE OF THE WEST 92.00 FEET OF SAID SECTION, THENCE SOUTH 0° 10' 30" WEST 115.00 FEET TO THE NORTHWEST CORNER OF SAID TRACT NO. 2228, THENCE ASLONG THE BOUNDARY OF SAID TRACT, NORTH 89° 59' 32" EAST 175.00 FEET, NORTH 0° 10' 30" EAST 20.00 FEET AND NORTH 89° 58' 32" EAST 15.00 FEET TO THE TRUE POINT OF BEGINNING; AND THAT PORTION OF THE SOUTHWEST ONE-QUARTER OF THE SOUTH- WEST ONE-QUARTER OF SECTION 13, TOWNSHIP 4 SOUTH, RANGE 11 WEST, IN THE RANCHO LOS COYOTES, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, AS SHOWN ON A MAP THEREOF, RECORDED IN BOOK 51, PAGE 11 MISCELLANEOUS MAPS, RECORDS OF SAID COUNTY.. EXCEPTING THEREFROM THAT PORTION DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE NORTH LINE OF THE SOUTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER OF SAID SECTION 13, DISTANCE THEREON, EAST 355.24 FEET FROM THE NORTHWEST CORNER OF SAID QUARTER SECTION, THENCE 11.82 FEET ALONG SAID NORTHERLY LINE, THENCE SOUTH 14.95 FEET, THENCE WEST 11.82 FEET, THENCE NORTH 14.95 FEET TO THE POINT OF BEGINNING; and - 2- WIiEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and ~~ WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearSng~ did adopt its Resolution No. PC80-230 . granted Conditional Use Permit No. 2142 and WHEREAS, thereafter, within the tir-e prescribed by law, an interested-party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WIiEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular, area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission said conditional use permit be, and the same is ere y, ~~~ and that Conditional Use Permit No. 2142 be, ..w_ and the same s ereby, granted permitting a 73-unit motel on the hereinabove described property with waivers of the following pro- visions of the Anaheim Municipal Code: ATTY-26 (Page 2 of 2 Pages) - 3 SECTION 18.44.062.011 - Maximum structural height. (0 feet permitted when building abuts RS-A-43,000 zoning; 32 feet proposed) SECTION 18.44.063.040 - Minimum landscaped setback. (10 feet required; none proposed) subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That fire sprinklers shall be installed in all kitchen efficiency units and all third floor units and smoke detectors shall be installed in all units. 4. That the owner of subject property shall submit a letter requesting the termination of Variance Nos. 2293 and 2245 to the Planning Department. 5. That a 6-foot high masonry wall shall be constructed along the south and east property lines and the easterly portion of the north property line abutting RM-1200 zoning. 6. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Revision No. 1 of Exhibit Nos. 1 through 4; provided, however, that kitchen efficiency units may be installed in no more than 25% of the units, with a maximum of 6-cubic foot refrigerators; two-burner stoves, excluding oven and baking faci- lities; and single compartment sinks; except that the manager's unit will be allowed to have full kitchen facilities. 7. That any parking area lighting proposed shall be down- lighting of a maximum height of 12 feet, which lighting shall be directed away from the north, east and south property lines to protect the adjacent residential uses. 8. That Condition No. 4, above-mentioned, shall be com- plied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. 9. That Condition Nos. 1, 3, 5, 6 and 7, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. -4- 10. That tenancies within each motel unit shall be limited to less than thirty consecutive days, 11. That no future parking variances or waivers shall be re- --~- quested in connection with said motel use of the premises, 12. That no windows shall be permitted on the second and third floors of that portion of the northern exterior wall of said development from the easterly property line to a point 100 feet westerly thereof. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions therein. BE IT FURTHER RESOLVED t~iat the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the con- ditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
