92-229 RESOLUTION NO. 92R-229 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CALIFORNIAt RECITIN~ THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 3, 1992t DECLARIN~ THE RESULT AND SUCH OTHER M~TTERS AS PROVIDED BY LAW. WHEREAS, a General Municipal Election was held and conducted in the City of Anaheim, California, on Tuesday, November 3, 1992, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in charter cities; and WHEREAS, pursuant to Resolution No. 92R-143 adopted June 23, 1992, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the City except absent voter ballots was 70,660. That the whole number of absent voter ballots cast in the City was 13,709, making a total of 84,369 ballots cast in the City. SECTION 2. That the names of the persons voted for at the election for Mayor are as follows: Fred Hunter Tom Daly That the names of persons voted for at the election for Member of the City Council are as follows: Frank Feldhaus Bill Fitzgerald Edward S. Skinner Fares (Ferris Batarseh Bob Zemel Keith Olesen Manuel T. Ontiveros William D. "Bill" Ehrle Frank E. Turner Tom Daly Todd E. Kaudy Phil Knypstra That the measures voted upon at the election are as follows: MEASURE NO. A - CITY COUNCIL TERM LIMITS. Shall Section 503.5 be added to the City Charter generally limiting consecutive years of service by members of the City Council, including the Mayor, to a combined total of two four-year terms? -1- MEASURE NO. B - UTILITY REVENUE TRANSFER LIMITS. Shall Section 1221 of the City Charter which provides restrictions upon the City Council in establishing water and electric utility rates be amended to provide that not more than 8 percent of the gross revenues earned by each utility during the preceding fiscal year may be paid into the general fund of the City during any fiscal year7 MEASURE NO. C - CLOSED SESSION MEETINGS. TECHNICAL AMENDMENT. Shall Sections 510 and 904 of the City Charter be amended to conform to the requirements of state law concerning the permissible grounds for holding closed session meetings by the City Council and its boards and commissions? MEASURE NO. D - MAXIMUM FINES. TECHNICAL AMENDMENT. Shall Sections 515 and 1501 of the City Charter be amended to increase the maximum fine for Charter or ordinance violations from $500 to $1000 to conform to state law and to allow future fine increases in conformance with state law change? MEASURE NO. E - PUELIC CONTRACT BIDDING. TECHNICAL AMENDMENT. Shall Section 1211 of the City Charter be amended to conform certain language in said section to the provisions of state law relating to the requirement to award certain public works contracts to the lowest responsible bidder? MEASURE NO. F - CLAIMS AGAINST THE CITY. TECHNICAL AMENDMENT. Shall Section 1217 of the City Charter be amended to conform the time limits within which th~ City is required to act on claims against the City to the provisions of state law? MEASURE NO. G - READING OF ORDINANCES AND RESOLUTIONS. TECHNICAL AMENDMENT. Shall Section 511 of the City Charter be amended to authorize the City Council to adopt a single motion at any City Council meeting waiving the oral reading of the complete text of all ordinances and resolutions adopted at such meeting in lieu of the current procedure which requires a separate waiver for each ordinance or resolution? MEASURE NO. H - ADVISORY VOTE ONLY CAMPAIGN CONTRIBUTION LIMITS. Should the City Council adopt an ordinance limiting the amount of campaign contributions a city candidate may receive from any single source to $1,000 per election? SECTION 3. That the number of votes given at each precinct and the number of votes given in the City of each of the persons above named for the respective offices for which the persons were candidates (and for and against the measures were as listed in Exhibit "A" attached. SECTION 4. The City Council does declare and determine that Tom Daly was elected as Mayor for the full term of 2 years; Tom Daly was elected as Member of the City Council for the full term of four years; Frank Feldhaus was elected as Member of the City Council for the full term of four years. That as a result of the election, a majority of the voters voting on Measures A, C, D, E, F, G, H did vote in favor of and that the measures were carried, and shall be deemed adopted and ratified. A majority of the voters voting on Measure B did not vote in favor and that measure did not carry and shall not be deemed adopted. -2- SECTION 5. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) The measures voted upon; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against each measures; (6) The total number of votes given to each person, and for and against each measure. SECTION 6. That the City Clerk shall immediately make and deliver to each of the persons so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it in the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they have been elected. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED ON NOVEMBER 17, 1992.
