1981-101RESOLUTION NO. 81R-101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF A CERTAIN PUBLIC SERVICE EASEMENT. WHEREAS, the City Council of the City of Anaheim has elected to proceed pursuant to the provisions of the Public Services Easements Vacation Law (Section 50430 et seq. Government Code) in connection with the vacation and abandonment of public service easements; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described public service easement {hereinafter "Easement"), to wit: That certain easement as granted by James Nitti and Irene Nitti to the California Edison Company for elec- trical utility purposes to construct, use, maintain, alter, add to, repair, replace and/or remove, in and over that real property situated in the City of Anaheim, County of Orange, State of California as re- corded in Book 1597, page 534 in the office of the County Recorder of said Orange County located over that portion of the South one-half of the Southeast one-quarter of Section 23, Township 4 South, Range 10 West, San Bernardino Base and Meridian as conveyed to said Grantors by deed recorded September 23, 1947 as Instrument No. 39683 in the office of the County Recorder of said Orange County described as follows: All poles shall be erected and maintained within one foot of the following described line: Beginning at an existing Southern California Edison Company Pole #102506-E located in the Westerly side of Placentia Avenue as now established 60 feet wide along the East- erly side of said property of the Grantors, which pole is approximately 190 feet Northerly, measured parallel with said Easterly line from the Southerly line of said Northeast one-quarter; thence Southwest- erly in a straight line to a point which is 170 feet Westerly and 160 feet Northerly, measured at right angles from the Easterly line and Southerly line respectively of said Northeast one-quarter of Section 23; and WHEREAS, on the 10th day of March, 1981, a public hearing was held to allow interested persons to submit evidence concerning said proposed abandonment; and -1- 80-5A WHEREAS, the City Council of the City of Anaheim does find from the evidence submitted to it, that said Easement is un- necessary for present or prospective public use. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation and abandonment of said Easement. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Anaheim to be recorded in the Office of the County Re- corder of Orange County, California.
