1981-104RESOLUTION NO. 81 R- 104
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM TERMINATING THE CONSTRUCTION CON-
TRACT WITH B-1 ENTERPRISES CORPORATION; AND
AUTHORIZING SOLICITATION OF BIDS FOR PERFORM-
ANCE OF THE UNCOMPLETED WORK.
WHEREAS, the City of Anaheim did, by Resolution No. 80R-377,
award a contract for the Acacia Street Storm Drain to B-1 Enterprises
Corporation; and
WHEREAS, B-1 Enterprises Corporation has failed to perform
said work in accordance with the terms of the contract and has aban-
doned the work; and
WHEREAS, the balance of the work to be performed by B-1 is
of urgent necessity for the preservation of life, health or property.
NOW, THEREFORE, the City Council of the City of Anaheim
does determine as follows:
1. That the contract for the Acacia Street Storm Drain be,
and it is hereby, terminated.
2. That the City Engineer be, and he is hereby, authorized and
directed to secure or cause to be secured a contractor to complete
the Acacia Storm Drain, at the account of B-1 Enterprises. The City
Engineer need not seek competitive bids for the balance of the work
pursuant to Section 1211 of the City Charter.
3. The City Engineer shall present the contract for the bal-
ance of the work to the City Council at the earliest possible time
in the event the bonding company will not complete the work.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim
