1981-129RESOLUTION NO. 81R-1l9 A RESOLUTION OF THE CITY COiTNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM P-lUNICIPAL COVE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUTID- ARIES OF CERTAIN ZONES SFiOLTLn BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. tt0-81-13 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described and, at said hearing, did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty (40) days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing and approved the proposed amendment; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the same; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should he adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following de- scribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the Northeast quarter of the Southeast quarter of section 20, Township 4 South, Range 10 West, in the Rancho Las Bolsas as shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Begin- ning at the northeast corner of the Southeast quarter -1- 80-81-13 ATT V-18-C of said Section 20~ thence West along the North line of said Northeast quarter 1323.85 feet to the Northwest corner of said Northeast quarter thence South along the West line of said Northeast quarter to the North west corner of the land conveyed to A.B. Coffman by deed recorded July 3, 1925, in Book 598, Page 204 of Deeds, records of said Orange County; thence East along the North line of said land so conveyed 1323.03 feet to the east line of said Section 20, thence North along said east line to the point of beginning. EXCEPTING THEREFROM the following: Beginning at the Northwest corner of the Northeast quarter of the Southeast quar- ter of said section, as said corner is shown on the map of Tract No. 2737, recorded in Book 93, Pages 17 and 18, Miscellaneous Maps, records of said Orange County, and running thence South 89 degrees 30' 00" East along the North line of said Northeast quarter, being the center line of Cerritos Avenue (40 feet in width) 339.48 feet; thence South 0 degrees 55' 13" West parallel with the West line of said Northeast quarter 662.82 feet to the North line of said Tract No. 2737; thence North 89 de- grees 05' 00°' West along said North line, and the West- erly extension thereof 339.47 feet to the West line of said Northeast quarter; thence North 0 degrees 55' 13" East along the West line, 660.35 feet to the point of beginning. ALSO EXCEPTING THEREFROM the Southerly 200 feet of the Easterly 227 feet, be excluded from the "RS-A-43,000" RESIDENTIAL/AGRICULTURAL ZONE and incorporated in the "RM-3000" RESIDENTIAL, MULTIPLE-FAMILY ZONE of the City of Anaheim, subject to the following conditions: 1. That all engineering requirements of the City of Anaheim along Cerritos Avenue and Euclid Street including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving;, drainage facili- ties or other appurtenant work; shall be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the City Engineer; that street lighting facilities along Cerritos Avenue and Euclid Street shall be installed as re- quired by the Office of Utilities General Manager, and in accordance with specifications on file in the Office of Utilities General Manager and/or that a bond; certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of the above-mentioned requirements prior to occupancy. 2. That the owner of subject property shall pay to the City of Anaheim a fee, in an amount as determined by the City Council, for tree planting purposes along Cerritos Avenue and Euclid Street. 3. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. - 2- 4. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 5. That subject property shall be served by underground utilities. 6. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. (A storm drain lateral shall be constructed in Cerritos Avenue so that ultimately all drainage from subject property will be taken back to the pro- posed drain in Euclid Avenue.) 7. That the owner of subject property shall pay to the City of Anaheim the park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 8. That the original documents of the covenants, conditions, and restrictions, and a letter addressed to developer's title com- pany authorizing recordation thereof, shall be submitted to the City Attorney's office and approved by the City Attorney's Office, Public Utilities Dept., Building Division, and the Engineering Division prior to final tract map approval. Said documents, as approved, shall be filed and recorded in the Office of the Orange County Recorder. 9. That street names shall be approved by the City Planning Department prior to approval of a final tract map. 10. That all private streets shall be developed in accordance with the City of Anaheim's Standard Detail No. 122 for private streets, including installation of street name signs. Plans for the private street lighting, as required by the standard detail, shall be submitted to the Building Division for approval and inclusion with the building plans prior to the issuance of building permits. (Private streets are those which provide primary access and/or cir- culation within the project.) 11. If permanent street name signs have not been installed, temporary street name signs shall be installed prior to any occu- pancy. 12. That an ordinance rezoning the subject property shall in no event become effective except upon or following the recordation of Final Tract Map No. 11053 within the time specified in Government Code Section 66463.5 or such further time as the advisory agency or City Council may grant. 13. That the owner of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as deter- mined by the City Council, for each new dwelling unit prior to the issuance of a building permit. -3- 14. That all on-site sanitary sewers shall be private. 15. That appropriate water assessment fees as determined by the Office of the Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit . 16. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 6. 17. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 2, 8 and 12, above-mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the Planning Commission unless said conditions are complied with within one year from the date hereof, or such further time as the Planning Commission may grant. 18. That Condition Nos. 3, 5, 6, 10 and 16, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such conditions, or any part thereof, be declared invalid or unenforce- able by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained shall be deemed null and void. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
