1981-130RESOLUTION N0. 81R-130 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM QRANTIN(3 CONDITIONAL USE PERMIT N0. 2119 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from MARY S. NELSON, ADMINISTRATOR FOR IDA M. RANNOW ESTATE, owner; and LINDBORG-DARE INVESTORS, agent, to permit a 5-lot, 220-unit condominimum subdivision with waivers of certain here- inafter specified provisions of the Anaheim Municipal Code on certain real property located in the City of Anaheim, County of Orange, State of California, legally described as: That portion of the Northeast quarter of the Southeast quarter of section 20, Township 4 South, Range 10 West, in the Rancho Las Bol,sas as shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps, records of Orange County, California, described as. follows: Begin- ning at the northeast corner of the Southeast quarter of said Section 20; thence West along the North line of said Northeast quarter 1323.85 feet to the Northwest corner of said Northeast quarter thence South along the West line of said Northeast quarter to the Northwest corner of the land conveyed to A.B. Coffman by deed recorded July 3, 1925, in Book 598, Page 204 of Deeds, records of said Orange County; thence East along the North line of said land so conveyed 1323.03 feet to the east line of said Section 20, thence North along said east line to the point of beginning. EXCEPTING THEREFROM the following: Beginning at the Northwest corner of the Northeast quarter of the Southeast quar- ter of said section, as said corner is shown on the map of Tract No. 2737, recorded in Book 93, Pages 17 and 18, Miscellaneous Maps, records of said Orange County, and running thence South 89 degrees 30' 00" East along the North line of said Northeast quarter, being the center line of Cerritos Avenue (40 feet in width) 339.48 feet; thence South 0 degrees 55' 13" West parallel with the West line of said Northeast quarter 662.82 feet to the North line of said Tract No. 2737; thence North 89 de- grees 05' 00" West along said North line, and the West- erly extension thereof 339.47 feet to the West line of said Northeast quarter; thence North 0 degrees 55' 13" East along the West line, 660.35 feet to the point of beginning. ALSO EXCEPTING THEREFROM the Southerly 200 feet of the Easterly 227 feet; and -1- ATTV-26 (PSy~ 3 of 2 Pays) WIiEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.A3 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC80-229 , granting, in part, Conditional Use Permit No. 2 and WIiEREAS, thereafter, within the tir-e prescribed by law, an interested-party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and dfd give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WIiEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is . adequate to allow the full development of the proposed use in a manner not detrimental to the particular, area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission gran~tin in part,said conditional use permit be, and the same is erh a modified and that Conditional Use Permit No. 21~T be, and the same s ereby, granted permitting a 5-lot, 178-unit condo- minium project on the hereinabove described parcel of real property with waivers of the following provisions of the Anaheim Municipal Code -- 2- ATTY-26 (Page 2 of 2 Pages) SECTION 18.31.061.012 - Minimum lot area per dwelling unit. (3000 square feet required; 2100 feet proposed) SECTION 18.31.062.012 - Maximum structural height. (1 story permitted within 150 feet of single-family residential zoning; 2 stories proposed) SECTION 18.31.062.030 - Minimum floor area. (750, 950 and 1150 square feet per unit required; 679, 931 and 1109 square feet per unit proposed) SECTION 18.31.066.010 - Minimum number of parking spaces. (720 spaces required; 499 spaces proposed) subject to the following conditions: 1. That this Conditional Use Permit is granted subject to the completion of Reclassification No. 80-81-13, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 7. 3. That the total number of condominium units for said pro- ject shall be reduced to 178. 4. That said project shall be developed in accordance with now pending revisions to the RM-3000 site development standards without variances. 5. That the developer shall submit to the City and obtain approval by the City Council of a revised land use plan for the project. 6. That this Conditional Use Permit is granted subject to the adoption of said revisions to the RM-3000 site development stand- ards prior to approval of the final subdivision map for the project. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition or any part thereof, be declared invalid or unen- forceable by the final judgment of any court of competent jurisdic- tion, then this Resolution, and any approvals herein contained, shall be deemed null and void. - 3- BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
