1981-194RESOLUTION NO. 81R ~ 194 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM INITIATING ANNEXATION PROCEEDINGS FOR JEFFERSON-ORANGETHORPE NO~ 2 ANNEXATION "`"~` TO THE CITY OF ANAHEIM AND FIXING A TIME, DATE AND PLACE OF HEARING ON SAID PROPOSED ANNEXATION PURSUANT TO SECTION 35220 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA WHEREAS, a resolution for the proposed annexation desig- nated Jefferson-Orangethorpe No. 2 Annexation to the City of Anaheim in the County of Orange was heretofore filed by the City of Anaheim and accepted for filing January 9, 1981, by the Executive Officer of the Local Agency Formation Commission pursuant to Part 2 of Title 4, Division 2; commencing with Section 35000 et seq. of the Government Code° and WHEREAS, the distinctive short form designation assigned by the Commission to the territory proposed to be annexed is~ JEFFERSON-ORANGETHORPE NO. 2 ANNEXATION TO THE CITY OF ANAHEIM° and WHEREAS., said territory proposed to be annexed to the City of Anaheim consists of approximately 24.48 acres of land lo- cated on the west side of Jefferson Street between Miraloma Avenue and Orangethorpe Avenue, in the County of_ Orange, and the exterior boundaries thereof are specifically described in the legal descrip- tion attached hereto and by this reference made a part hereof; and WHEREAS, the Commission has heretofore determined in its Resolution No. 81-17, adopted on February 11, 1981 that the terri- tory proposed to be annexed is uninhabited; and WHEREAS.- the reasons for the proposed annexation to the City of Anaheim as set forth in the proposal thereof submitted to the Commission by the City of Anaheim are as followso 1. Requests by the owners of a certain portion of said unin- corporated territory for annexation to the City of Anaheim- and 2. To provide full municipal services to an unincorporated area that is remote from County service .f_acilities and thereby increase the economy and efficiency of urban services. WHEREAS the Commission's Resolution No. 81-17, making determinations, set forth the following terms and conditions of ,.-.. said proposed annexation -l- .l. The undaries o_f the territory _~oposed to be annexed to the City of Anaheim are specifically described in the legal descrip- tion attached to said Commission Resolution and by such reference made a part thereof. Said territory is found to be uninhabited and is assigned the following designation° JEFFERSON-ORANGETHORPE NO. 2 ANNEXATION TO THE CITY OF ANAHEIM. 2. The City of Anaheim is designated as the conducting author- ity and the City Council thereof is directed to initiate annexation proceedings in compliance with said Commission Resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS: 1. That the City of Anaheim does hereby initiate proceedings pursuant to Section 35220 of the Government Code for the annexation of the hereinabove described territory to the City of Anaheim. 2. That June 9 1981, at the hour of 3:00 p.m. in the Council Chambers of the Anaheim Civic Center, 200 South Anaheim Boulevard, Anaheim- California, is hereby fixed as the time and place when and where the City Council will hear and resolve any oral and written protests, objections, or evidence which shall be made, pre- sented or filed relating to said proposed annexation. 3. That any owner of land within the territory proposed to be annexed may file a written protest against the annexation with the City Clerk of the City of Anaheim at any time prior to the conclusion of the City Council's hearing on the proposed annexation. Each protest shal]_ state the name and address o.f the owner of the land affected and the street address or other description sufficient to :identif_y the location of such land. Protests may be made on behalf of_ an owner by an agent authorized in writing by the owner to act as agent with respect to such land. Protests may be made on behalf of a private corporation which is an owner of land by any officer or employee of the corporation without written authorization by the corporation to act as agent in making such protest. 4. The City Clerk shall cause notice of the hearing on the proposed annexation to be given as provided in Sections 35222 and 35223 of the Government Code of the State of California. 5 . That, pursuant to the provisions of Paragraph 6 (a) (2 ) of that certain Master Property Tax Transfer Agreement Between the County of Orange and the City of Anaheim dated October 28, 1980 ("Agreement"). the County Administrative Officer and the City Manager, or their designees, have heretofore agreed in writing that said terri- tory to be annexed to the City of Anaheim shall be deemed and treated as "developed" property for purposes of said Agreement.
