A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING A PUBLIC UTILITY EASEMENT
LOCATED NORTH OF LA JOLLA STREET, WEST OF
KRAEMER BOULEVARD.
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate cer-
tain public streets, highways or public service easements pursuant
to the Public Streets, Highways and Service Easements Vacation Law;
and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 13th day of October, 1981, a public hear-
ing was held to allow interested persons to submit evidence concern-
ing said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not re-
served and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of that easement
for public utility purposes, more specifically described as follows:
That certain public utility easement recorded in Book
2618, page 225, Records of Orange County, California,
located in the City of Anaheim, County of Orange, State
of California, to be abandoned, described as follows:
An easement for the construction use, maintenance to
alter, add to repair, replace and /or remove in, on and
over said land with electric line consisting of poles
necessary guys and anchors, cross arms, wires and other
fixtures and appliance for conveyance of electric energy
to be used for light heat power, telephone and other
purposes in and to:
Lot 3 in Block 6 and Lot 4 in Block 5 of the Golden
State Tract, as per map recorded in Book 4, Miscellane-
ous Maps, pages 66 and 67, records of said Orange County.
All poles shall be erected and maintained within one
foot of the following described line:
A line parallel with and 290 feet westerly measured at
right angles from the east line of said Lot 4 and a
line parallel with and 224 feet westerly measured at
right angles from the east line of said Lot 3.
It is understood and agreed that the above line de-
scription is approximate only, it being the intention
of the Grantor, by this conveyance, to grant an ease-
ment for said electric line in the location in which
said electric line shall be constructed on and over
the above described property.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 13th day of October, 1981.
