1981-496WHEREAS, a petition for the proposed annexation designated
Ball Freeway No. 3 Annexation to the City of Anaheim in the County
of Orange was heretofore filed by the owners of said property and
accepted for filing by the Executive Officer of the Local Agency
Formation Commission of Orange County, California "Commission
pursuant to Part 2 of Title 4, Division 2, commencing with Section
35000 et seq. of the Government Code; and
WHEREAS, the distinctive short form designation assigned
by the Commission to the territory proposed to be annexed is: BALL
FREEWAY NO. 3 ANNEXATION TO THE CITY OF ANAHEIM; and
WHEREAS, said territory proposed to be annexed to the
City of Anaheim consists of approximately 34.731 acres of land, and
the exterior boundaries thereof are specifically described in the
legal description attached hereto, marked Exhibit "A" and by this
reference made a part hereof; and
WHEREAS, that certain Master Property Tax Transfer
Agreement between the County of Orange and the City of Anaheim,
dated October 28, 1980, provides that the County and City shall
agree in writing as to whether said territory to be annexed shall
be deemed developed or undeveloped property for the purpose of
transfer of property taxes pursuant to Section 99(b) of the Revenue
and Taxation Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that, pursuant to the provisions of Paragraph 6(a)(2)
of that certain Master Property Tax Transfer Agreement between the
County of Orange and the City of Anaheim dated October 28, 1980,
"Agreement the County Administrative Office and the City Manager,
or their designees, have heretofore agreed in writing that said ter-
ritory to be annexed to the City of Anaheim shall be deemed and
treated as "undeveloped" property for purposes of said Agreement.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 7± day October, 1981.

That portion of the Van De Graaff Tract as shown on a map recorded in Book 4,
Page 440 of Miscellaneous ,Records in the Office of the County Recorder of Los
Angeles County, California and also partially within that certain 51.0295 acre
parcel of land as shown on a map recorded in Book 7, Page 7 of Record of Sur-
vey Maps, records of Orange County, California in the unincorporated territory
of the County of Orange, State of California, described as follows:
Beginning at a point in the existing City limit line of the City of Anaheim, said
point of beginning being the most Easterly corner of the Ball- Freeway Annexation
to the City of Anaheim, said corner being on the arc of a 1200.00 foot radius curve
concave Southwesterly and being the constructed centerline of Ball Road; a radial
line of said curve bears North 30° 35' 16" East through said corner; the Ball
Freeway Annexation describes said radial line as having a bearing of North 31° 23' 31"
East; thence Southeasterly along said centerline and said curve 9.45 feet through a
central angle of 0° 27' 04 thence continuing along said centerline South 58° 57' 40"
