92-211 RESOLUTION NO. 92K-2II A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 3441 AND AMENDING RESOLUTION NO. 91R-275. WHEREAS, the City Council of the city of Anaheim heretofore adopted Resolution No. 91R-275 approving Conditional Use Permit No. 3441, subject to certain conditions specified therein; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the city Council held a duly noticed public hearing on September 29, 1992, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the City Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the city Council of the City of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 3441 be, and the same are hereby, amended by the amendment of Condition No. 21 as set forth in Resolution No. 91R-275 to read as follows: "21. That prior to issuance of a building permit, the legal property owner shall ' enter into an unsubordinated recorded ~' agreement with the city of Anaheim to provide that three (3) of the residential units shall be rented as Very-Low-Income Housing pursuant to California Government Code Section 65915 and Anaheim Municipal Code Chapter 18.99 (density bonus), and that an additional four (4) of the residential units shall be rented as Very- Low-Income Housing pursuant to Anaheim Municipal Code Chapter 18.94 (senior citizens apartments), with appropriate rental controls as approved by the City of Anaheim for a period of not less than thirty (30) years from the date of issuance of occupancy permits. A copy of the recorded covenant shall be submitted to the Planning Department." BE IT FURTHER RESOLVED that new Condition No. 20a be, and the same is hereby, added to Conditional Use Permit No. 3441 to read as follows: "20a. That the specific landscaping plan, required in connection with Condition No. 20 of Resolution No. 91R-275, shall include enhancement of the front landscaped setback and at least five (5) trees, in compliance with Section 18.04.060.013 of the Anaheim Municipal Code." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution No. 91R-275 shall remain in full force and effect.
