1981-553RESOLUTION NO. 81R -553 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A PORTION OF CANYON RIM ROAD, WEST OF SERRANO AVENUE. WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate cer- tain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 1st day of December, 1981, a public hear- ing was held to allow interested persons to submit evidence conc .ern- ing said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described in unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, the City Council does determine that the public convenience and necessity require the reservation and exception of the easement(s) and right(s) of way hereinafter specifically described. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not re- served and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of a portion of Canyon Rim Road, west of Serrano Avenue, more specifically de- scribed as follows: That portion of Canyon Rim Road in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 137, pages 15 and 16 of Parcel Maps, Records of Orange County, described as follows: COMMENCING at the centerline intersection of Canyon Rim Road and Serrano Avenue as shown on said Parcel Map, said centerline intersection being a point on a curve concaved Southeasterly having a radius of 1000.00 feet, a radial line through said point bears North 44° 57' 42" West; thence along said radial line and the centerline of Canyon Rim Road North 44° 57' 42" West 60.00 feet to the beginning of a curve concaved South- westerly having a radius of 800.00 feet; thence North- westerly 510.74 feet along said curve through a central angle of 36° 34' 44" to a point on a radial line bearing North 8° 27' 34" East; thence South 8° 27' 34" West 39.00 feet to a point on the Southerly line of said Canyon Rim Road, said point being the TRUE POINT OF BEGINNING, said point also being the beginning of a curve concaved Southerly having a radius of 210.00 feet; thence Easterly 76.26 feet along said curve through a central angle of 20° 48' 25" to the beginning of a reverse curve concaved Northeasterly having a radius of 400.00 feet; thence Southeasterly 119.93 feet along said curve through a central angle of 17° 10' 42" to the beginning of a reverse curve concaved Southwest- erly having a radius of 210.00 feet a radial line through said reverse curve bears North 12° 05' 17" East; thence Southeasterly 56.94 through a central angle of 15° 32' 03" to a point of cusp a radial line through said point of cusp bears North 27° 37' 20" East, said point also being the Southwesterly line of said Canyon Rim Road; thence North 62° 22' 40" West 50.35 feet to the beginning of a curve concaved Southwesterly having a radius of 607.60 feet; thence Northwesterly 203.21 feet along said curve through a central angle of 19° 09' 46" to the TRUE POINT OF BEGINNING. Reserving therefrom unto the City of Anaheim a public utility easement for the installation and maintenance of underground and overhead electric wires, cables, and re- lated electrical facilities over, under and across the above said portion of Canyon Rim Road. Together with all reasonable rights of ingress and egress. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange at such time as all of the following conditions precedent to said vacation have been fulfilled: 1. Removal and reconstruction of existing street improve- ments to conform to the precise grading plan for Tract No. 10941. 2. Disconnection of the sprinkler system from the City's system and connection to the Homeowner's Association system sub- ject to the approval of the Parkway Maintenance Supervisor.
