1981-554RESOLUTION NO. 81R- 554 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A LOCAL SANITARY SEWER PLAN AND MAP FOR THE LAKEVIEW OFFSITE SEWER REIMBURSEMENT AREA PURSUANT TO SECTION 17.08.430 OF THE ANAHEIM MUNICIPAL CODE. WHEREAS, Section 66483 of the Government Code of the State of California authorizes local ordinances to impose a require- ment for the payment of fees for purposes of defraying the actual or estimated costs of constructing planned sanitary sewer facilities for local sanitary sewer areas; and WHEREAS, the City Council of the City of Anaheim has here- tofore adopted Section 17.08.430 of the Anaheim Municipal Code authorizing imposition of fees and execution of reimbursement agree- ments with subdividers for construction of facilities of supplemental size or capacity in areas where the City has adopted a local sanitary sewer plan and map; and WHEREAS, the City of Anaheim desires to adopt a local sani- tary sewer plan and map for the Lakeview Offsite Sewer Reimbursement Area and to impose fees and execute reimbursement agreements pursuant thereto. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby adopt a local sanitary sewer plan and map for the Lakeview Offsite Sewer Reimbursement area which plan and map is attached hereto and incorporated herein by this reference. BE IT FURTHER RESOLVED that the City of Anaheim does hereby impose sanitary sewer acreage fees for all subsequent developments within the area of benefit as described on said map in accordance with the amounts set forth in the hereinabove described plan. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does hereby find that subdivision and development of property within the planned local sanitary sewer area will require construction of the facilities described in the sewer plan, and that the fees are fairly apportioned within such area either on the basis of benefits conferred on property proposed for subdivision within the area. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 1st day of December, 1981. SANITARY SEWER PLAN AND MAP FOR LAKEVIEW OFFSITE SEWER REIMBURSEMENT AREA Texaco Anaheim Hills proposed building three tracts adjacent to the south side of Nohl Ranch Road at Meats Avenue. The tracts are Tract 8116, Tract 8117 and Tract 9864. The developer, Texaco Anaheim Hills, was required to construct an offsite sewer line to serve and benefit the proposed tracts and additional areas as shown on the map marked Exhibit "A," attached hereto and incorporated herein by this reference. An existing 8 -inch V.C.P. sewer line in Peralta Hills Drive was ex- tended south 1440 feet to Nohl Ranch Road to serve the subject area. Due to an immediate demand for sewer service in the Peralta Hills area, the City of Anaheim performed the required engineering and had constructed the lower 600 feet of 8 -inch sewer line. Texaco Anaheim Hills engineered and contracted for the construction of the remaining 840 feet of 8 -inch sewer line. The City of Anaheim expended $9,872.63 for the portion of sewer line the City constructed; Texaco Anaheim Hills expended $63,320.07 for the remaining 840 feet of sewer line. It is proposed that the following sewer acreage fees be collected to reimburse the costs incurred for the engineering and construction of the Lakeview Offsite Sewer. $350 /Acre City of Anaheim sewer fees (See Resolution No. 63R -1) 80 /Acre City cost of Lakeview Sewer $460 /Acre Texaco Anaheim Hill's costs $890 /Acre Total sewer fees per acre Consequently, $430 per acre is to be collected and put in the City Sewer Fee Fund; $460 is to be put in a new trust fund to reimburse Texaco Anaheim Hills, Inc. r j TeYace Atuh.ae n, #/JJs j/ L AKEV /EW OFFS /rE SEWER REIMBURSEMENT AREA O y EXHIBIT A
