1981-593RESOLUTION NO. 81R -593 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A FORMER SOUTHERN CALIFORNIA EDISON COMPANY EASEMENT LOCATED NORTH OF MIRA- LOMA AVENUE AND WEST OF JEFFERSON STREET. WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 29th day of December, 1981, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or propspective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not re- served and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of that public utility easement, more specifically described as follows: The easterly 576.80 feet of that certain electrical easement granted by C. Darle Hale, Howard H. Hungerford and Robert R. Allen to the City of Anaheim, in the County of Orange, State of California as re- corded in Book 9689 pages, 687 and 688 in the Office of the County recorder of said Orange County for the installation and maintenance of poles and electrical power lines over, under and across a strip of land 5.00 feet in width, being a portion of Lot 42 of Hazard's Subdivision, as per map filed in Book 1, page 26 of Record of Surveys, in the office of the county recorder of said Orange County, the northerly line of said 5.00 feet strip being described as follows: -1- 81 -11A Beginning at a point in the west line of said Lot 42, N 3 35' 00" W, 424.64 feet from the southwest corner thereof, thence N 89 20' 33" E, parallel to the south line of said line, a distance of 1,328.87 feet to a point of terminus in the westerly line of the Atchison, Topeka and Santa Fe Railway's 100 foot right of way, formerly L.A. Railway Company, as con- veyed by deed recorded June 4, 1887 in Book 239, page 27 of Deeds, records of said Orange County. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange.
