A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DISAPPROVING AN AMENDMENT TO EXHIBIT
NO. 7 OF THE SANTA ANA CANYON ACCESS POINTS
STUDY RELATING TO CERTAIN P~gPERTY LOCATED AT
6270 SANTA ANA CANYON ROAD.
WHEREAS, the city of Anaheim has heretofore adopted the
Santa Ana Canyon Access Points Study (the "Study") designating
certain approved limited access points along Santa Ana Canyon
Road as a logical and reasonable method of providing access to
certain properties abutting Santa Ana Canyon Road at such time as
said properties were to be developed for uses more intensive than
those currently existing; and
WHEREAS, said Study is a portion of the Circu]Lation
Element of the General Plan of the City of Anaheim and is used in
conjunction with the acquisition and/or vacation of abutters'
rights of access to Santa Ana Canyon Road in connection with the
approval of development of said abutting properties; and
WHEREAS, the owner of certain property abutting Santa
Ana Canyon Road has heretofore requested that the City consider
and approve a revision to Exhibit No. 7 of said Study to allow
access to and from Santa Ana Canyon Road in conjunction with a
proposed two story, 9-unit commercial retail center (the
"commercial center") for that certain irregularly-shaped parcel
of property consisting of approximately 0.94 acres having a
frontage of approximately 200 feet on the south side of Santa Ana
Canyon Road, having a maximum depth of approximately 435 feet,
being located approximately 515 feet west of the centerline of
Fairmont Boulevard, and further described as 6270 Santa Ana
Canyon Road (the "premises"); and
WHEREAS, the City Planning Commission has heretofore
held a duly noticed public hearing upon said request in
conjunction with aln application for a conditional use permit for
approval of the proposed commercial center and heretofore
approved~ inter alia, said conditional use permit and recommended
to the City Council the revision of Exhibit No. 7 to the Study as
contained in the Circulation Element of the General Plan; and
WHEREAS, the City Council, upon its own motion,
determined to review such decisions of the Planning Commission;
and
WHEREAS, the City Council did hold a duly noticed
public hearing on September 22, 1992~ to consider the aforesaid
applications and requests of the owner concerning the proposed
development of the premises and did receive public testimony and
evidence thereon; and
WHEREAS, the City Council, after due inspection,
investigation and study, and after due consideration of all
evidence and reports offered at said hearing, did adopt its
Resolution No. 92R- denying Conditional Use Permit No. 3527 to
permit the proposed commercial center; and
WHEREAS, based upon the denial of said conditional use
permit, the city Ceuncil determines that it is not in the public
interest or general welfare to amend Exhibit No. 7 of the Study
at this time.
NOW, THEREFORE, BE IT RESOLVED that the city Council of
the City of Anaheim does hereby disapprove the proposed amendment
to Exhibit No. 7 of the Study as incorporated in the Circulation
Element of the General Plan.
THE FOREGOING RESOLUTION is approved and adopted by the
city Council of the City of Anaheim this 22nd day of September,
1992.
