A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE EXECUTION OF AN
AGREEMENT BETWEEN LOUIS E. NOHL AND MARGARET
E. NOHL AND THE CITY Or ANAHEIM WITH REFERENCE
TO THE DEDICATION AND IMPROVEMENT OF A CERTAIN
EASEMENT FOR PIPELINE AND UTILITY AND SERVICE
ROAD PURPOSES.
WHEREAS, the City Council of the City of Anaheim con-
templates the inclusion of major portions of property owned by
Louis E. Nohl and Margaret E. Nohl within the city limits of the
City of Anaheim by way of annexation proceedings, including those
portions of said property owned by said Nohls covered by a certain
form of agreement this day submitted to the City Council to be
made and entered into between said Louis E. Nohl and Margaret E.
Nohl, as Grantors, and the City of Anaheim, as Grantee; and
WHEREAS, the City of Anaheim has entered into an agree-
ment with Louis E. Nohl and Margaret E. Nohl, which agreement
will enable the City of Anaheim to develop properties for the
construction of a reservoir, appurtenant facilities, water trans-
mission lines, and access and service roads; and
WHEREAS, the City Council does find and determine that
those portions of the said Nohl property covered by said form of
agreement this day submitted to the City Council and designated
as Parcels 8 and 9 on Exhibit "A" attached to said agreement,
should be developed for a service road and utility purposes in
order that said reservoir facilities may be utilized in the
effective storage and distribution of water for the benefit of
the residents of the City of Anaheim; and
WHEREAS, the City of Anaheim and Louis E. Nohl and
Margaret E. Nohl desire to enter into an agreement for the dedi-
cation and improvement of those portions of the Nohl property
described in said form of agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that an agreement be made and entered into
by and between Louis E. Nohl and Margaret E. Nohl, as Grantors,
and the City of Anaheim, as Grantee, providing for the dedication
to the City of an easement for pipeline and utility purposes and
a right -of -way for a service road over the property described in
the form of agreement this day submitted to the City Council and
designated as Parcels 8 and 9 on Exhibit "A" attached thereto,
and for the improvement of said easement upon the terms and con-
ditions substantially as set forth in said form of agreement this
day submitted to the City Council to be made and entered into
between the City and said Nohls.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
