64-857RESOLUTION NO 0 64R -857 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 64 -65 -43 to consider an amendment to Title 18 FE—Ar e eim un cipa Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evid: -rce ;:nd reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro posed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 24th day of November 19_64, as the time, and the City Council Charm er� a�it a� City N 1 of the City of Anaheim as the place for a public hearing upon said proposed am;- ndment to Title 18 of the Anaheim M.n.icipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zon- or zones herein ft r set forth, and did give notice there- of in the manner and fora as provided in said Tit1 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for` public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented :'t said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be ,dopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of An;:heim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit. PARCEL ONE: The South 248.38 feet of the West 404.85 feet of the North 15 acres of the Southwest quarter of the North- west quarter of Section 8, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 7 of Miscel- laneous Maps, records of Orange County, California. Excepting therefrom that portion thereof lying within the following described land: Beginning at a point in the West line of said Section 8, distant along said West line South 0 44' 50" East, 862.06 feet from the intersection thereof with the Southwesterly line of the Southern Pacific Railroad right of way; thence North 89 15' 10" East 50.00 feet to the line parallel with and distant 50.00 feet Easterly, measured at right angles, from said West line; thence along said parallel line North 0 44' 50" West, 75.00 feet; thence North 15 36' 04" East 156.15 feet to the South line of the real property described in deed to Bernard 0. Domries, and wife, recorded as Document No. 37380 in Book 2360, page 205 of Official Records; thence along said South line South 89 37' 40" West 93.96 feet to the said West line; thence along said West line South 0 44' 50" East, 225.46 feet to said point of beginning. Also excepting the Westerly 30 feet of the Southerly 95 feet lying within the right of way of Brookhurst Street. PARCEL TWO: The North 25 acres of the Southwest quarter of the Northwest quarter of Section 8, Township 4 South, Range 10 West, S.B.B. M. Excepting therefrom the Westerly 60 feet of the South 10 acres of said North 25 acres. Also excepting therefrom the South 248.38 feet of the West 404.85 feet of the North 15 acres of said North 25 acres. Also excepting therefrom that portion described as follows: Beginning at a point in the West line of said Section 8, distant along said West line South 0 44' 50" East 862.06 feet from the intersection thereof with the Southwesterly line of the Southern Pacific Railroad right of way; thence North 89 15' 10" East 50.00 feet to the line parallel with and distant 50.00 feet Easterly, measured at right angles, from said West line; thence along said parallel line North 0 44' 50" West 75.00 feet; thence North 15 36' 04" East 156.15 feet to the South line of the real property described in deed to Bernard 0. Domries, et ux, recorded as Document No. 37380 in Book 2360, page 205 -2- of Official Records; thence along said South line South 89 37' 40" West, 93.96 feet to the said West line; thence along said West line South 0 44' 50" East, 225.46 feet to said point of beginning. Also excepting therefrom that portion described as follows: Beginning at the Northwest corner of the above described property; thence East along the North line thereof, 265 feet; thence South, parallel with the West line of said property, 100 feet; thence West parallel with the North line thereof, 85 feet; thence South parallel to said West line 100 feet; thence West parallel to said North line, 180 feet to said West line; thence North along said West line, 200 feet to the point of beginning. Also Excepting therefrom a strip of land 100 feet wide conveyed by Alfred Robinson, Trustee, to Western Development Company by deed recorded June 12, 1876 in Book 44, page 496 of Deeds, records of Los Angeles County, California. Also Excepting therefrom a strip of land 100 feet wide (lying South of and adjoining the above mentioned foot strip), described in the deed from P. A. Stanton to Southern Pacific Railroad Company, recorded May 6, 1895 in Book 16, page 305 of Deeds, records of said Orange County. Also excepting therefrom the portion lying North and East of said railroad. PARCEL THREE: That portion of the Southwest quarter of the North- west quarter of Section 8, Township 4 South, Range 10 West, S.B.B. M., described as follows: Beginning at a point on the West line of said North- west quarter 306.92 feet North of the Southwest corner of said Northwest quarter and running thence North along said West line 167.75 feet, more or less, to a point 16 feet South of the South line of the North 25 acres of the Southwest quarter of the North- west quarter of said Section 8; thence East, parallel with said South line of said North 25 acres, 238 feet; thence South, parallel with the West line of said Northwest quarter, 168.15 feet to the Northeast corner of the land conveyed to Frances L. McNeill by deed recorded January 21, 1938 in Book 924, page 176 of Official Records; thence West along the North line of said land conveyed to McNeill, 238 feet to the point of beginning. Excepting the Westerly 60 feet lying within the right of way of Brookhurst Street. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and in- corporated in the following zones: That all of the above described property shall be changed to and incorporated in M -1, LIGHT INDUSTRIAL ZONE, with the exception of those areas lying immediately along and parallel to any arterial streets and highways as designated on the adopted Circulation Element of the General Plan, which areas shall be changed to P -L, PARKING LANDSCAPING ZONE, for a depth of fifty (50) feet, measured from the planned highway right -of -way line as designated on the Circulation Element of the General Plan "Highway Rights -of- Way." BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
