64-856RESOLUTION NO. 64R -856 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1663 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Richard 'olentz owner o cer a n rea proper y s uated Tn t o ty o na ze'fm, County of Orange, State of California, described as follows: The north 65.35 feet of Lot No. 1 of Tract No. 1071 as shown on a map recorded in Book 34 Page 39 of Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on October 19 1964 notice of which said public hearing was duly given as requ re'd by law and the provisions of.Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation_and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No, 1374, Series 19 64 65 denying Variance No. 1663 and WHEREAS, thereafter within twenty- two:(22) -days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the 24th day of er, 190 at 7;00 o'clock P.M. in the City Hall in the ty of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18,_Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity_and zone and denied the subject property, 2. It appears that the subject property can be adequately developed and used under the present zone. THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Variance No. 1663 be, and the same is hereby sustained, and that the petition of Richard M. Polentz for a zoning variance permitting a waiver of the minimum lot width and minimum lot area requirements to create an R -1 lot out of the property hereinbefore described, be, and the same is hereby denied.
