64-854WHEREAS, the CiryrPlannii9 Commission of the City of Anaheim did receive a petition for zoning variance from E. VAN CASTERENS, owner A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1662 RESOLUTION NO. 64R -854 �la of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Parcel 1: Beginning at the Northwest corner of Lot 14 of the P. A. Stanton Tract, as shown on a map recorded in Book 5, Pages 23 and 24 of Miscellaneous Maps, Records of Orange County, California, said point being situate South 89 59' 47" East 572.88 feet; and South 0 06' 33" West 20.00 feet from the intersection of Magnolia Avenue and Ball Road; thence, along the West line of said Lot 14, South 0 06' 33" West 314.03 feet to the Northwest corner of the land conveyed to Anaheim Union High School District of Orange County, recorded September 29, 1958 in Book 4429, Page 325 of Official Records; thence, along the North line of said land, South 89 56' 53" East 582.43 feet to the East line of Lot 13 of said Tract; thence, along said East line North 0 37' 23" West 314.54 feet to the Northeast corner of said Lot 13; thence, along the North line of said Lots 13 and 14, North 89 59' 47" West 585.25 feet to the point of beginning. Parcel 2: That portion of the West half of that certain street 40.00 feet wide lying adjacent to Lot 13 of the P. A. Stanton Tract, as shown on a map recorded in Book 5, Pages 23 and 24 of Miscellaneous Maps, records of Orange County, California. Excepting therefrom the Northerly 53.00 feet measured at right angles from the center line of Ball Road. Also excepting that portion lying Southerly of the Easterly prolongation of the North line of the land described in deed to the Anaheim Union High School District of Orange County,. recorded September 29, 1958 in Book 4429, Page 325 of Official Records. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on October 26, 1964 notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1383 Series 19 64 -65 recommending that Variance No. 1662 be granted subject to certain conditions therein set fort a nd WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 24th day of November 19 64 at 7 :00 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence nd reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the one -story height limitation within 150 feet of R -1, One- Family Residential, and R -A, Residential Agricultural, Zone properties to permit the construction of two -story apartment buildings, with carports, on the property herein before described, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. ATTEST: 3. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 4. That subject property shall substantially in accordance specifications on file with marked "Exhibits Nos. 2 and and "Exhibits Nos. 1, 4, 5, 5. That this variance is granted subject to the completion of Reclassification Proceedings No. 64 -65 -37 now pending. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
