64-816WHEREAS, the City Planning Commission of the City of Anaheim did hold a public he ring in Recl..•ssification Proceed ings No, 64 -65 -38 to consider an amendment to Title 18 0:" t :na elm un `cipa Code rel,.ting to zoning, and to consider a change in the bound•ries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence .•:nd reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of sid resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 4th day of November 19 64 as the time, and the City Council Chain aria �iiCity Fa l of the City of Anaheim as the place for public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed foe public he ring the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented :t said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be ,dopted and th -,t the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED RESOLUTION NO 64R -816 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of An:..heim, County of Orange, State of California, to wit That portion of Lot 24 of Golden State Tract No. 2, as shown on a Map recorded in Book 4, page 68 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point on the Easterly line of said Lot 24 distant North 0 48' 10" West 225.00 feet from the Southeast corner of said Lot 24; said South- east corner also being the center line intersection of East La Palma Avenue and Acacia Street, as shown on a Map of Tract No.1364, recorded in Book 52, pages 42 and 43 of Miscellaneous Maps, records of said Orange County; thence West, parallel with the South line of said Lot 24, a distance of 155.00 feet to the East line of said Tract No. 1364; thence North 0 48' 10" West along said last mentioned East line, 60.00 feet; thence East, parallel with said South line 155,00 feet to the Easterly line of said Lot 24; thence South 0 48' 10" East, along said East line, 60.00 feet to the point of beginning. be excluded from R-1, ONE-FAMILY RESIDENTIAL ZONE, and incor- porated in C-1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the follow- ing conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Acacia Street, for street widening purposes. 2. That the owners of subject property shall pay to the City of Anaheim the sum of 2.00 per front foot, along Acacia Street, for street lighting purposes. 3. That sidewalks shall be installed along Acacia Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, and that said sidewalks shall be installed prior to final building inspection. 4. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 5. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked "Exhibits Nos. 1, 2 and 3." 6. That all air conditioning facilities shall be properly shielded from view from abutting streets. 7. That a 6-foot masonry wall shall be constructed along the west and north property lines, the west wall to be constructed prior to final building -2- ATTEST: inspection, and the north wall to be constructed immediately after removal of the structure presently located on the premises, or prior to final building inspection, whichever occurs first. 8. That the owners of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the C -1 uses of subject property to business and professional offices, including a pharmacy, the primary use of which shall be the dispensing of drugs and medications, with only incidental sales of other merchandise. 9. That Conditions Nos. 1, 2 and 8 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
