64-807RESOLUTION NO. 64R -807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 624 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from William and Robert Dowling 3115 Flintridge Drive, Fullerton, California, to establish a service station within 75 feet of R -3, Multiple Family Residential, Zoned property, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: All that certain land situated in the State of California, County of Orange, Rancho San Juan Cajon de Santa Ana, described as follows: That portion of Block G of the Kraemer Tract, as shown on a map recorded in Book. 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, described as follows: Beginning at a point on the Southerly boundary of said Lot G, said point being the intersection of Orangethorpe Avenue and Dowling Avenue; thence, North 73 32' 00 East 242 feet, more or less, to a line perpendicular to the South line of said Lot G and 203 feet distant from the proposed realignment of Dowling Avenue; thence, North 16 28' 00 West 203.00 feet; thence, parallel with the South line of said Lot G, South 73 32' 00" West 209 feet, more or less, to the centerline of Dowling Street; thence, along said centerline, South 7 East 207 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on September 14 1964 notices of which yy gi said public hearing were du ven as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 1330 Series 1964 -65 granting Conditional Use Permit No. 624, subject to the conditions therein set forth and -1- Ta thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, torfWview the action of the City Planning Commission in granting said Conditional Use Permit and did thereupon fix the 20th day of October 1964 as the time and the Council Chamber in the City Hall of he City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given s required by law .nd the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct 'such hear- ing and did give all persons interested therein an opportunity. to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful conside- ration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not :adversely affect the adjoining land uses and the growth and development of the are in which it is proposed to be loc. ted. -2- 3, The size and shape of the site proposed for the use is adequ;: to to allow, the full development of the proposed use in manner not detrtbnental to the particular rea nor to the peace, health, safety and general welfare. 4 The traffic generated by the proposed use will not impose an undue burden upon t&.s reets and high ways designed nd improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the :.ction of the City Planning Com- mission ranting said Conditional Use Permit be, and the same is hereby sustained and th t Conditional Use Permit No. 624. be, nd the same is hereby, granted permitting the establishment of a service station within 75 feet of R -3, Multiple Family Residential, Zoned property, on the property hereinbefore described, subject to the following conditions: 1. That subject property shall be developed substantially in accordance with City of Anaheim Service Station Minimum Site Development Standards, and substantially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibits Nos. 1, 2 and 3." 2. That a 6 -foot masonry wall shall be constructed along the north and east property lines of subject property prior to final building inspection. 3. That this Conditional Use Permit is granted subject to the completion of Reclassification Proceedings No. 64 -65 -28 now pending. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the condition(s) herein.
