1965-355RESOLUTION NO. 65R- 355 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING AN EASEMENT FOR PUBLIC ROAD AND HIGHWAY PURPOSES IN, ON, OVER AND ACROSS CERTAIN REAL PROPERTY, FROM SOUTHERN CALIFORNIA EDISON COMPANY. WHEREAS, Southern California Edison Company a cor- poration organized under the laws of the State of California, has tendered to the City of Anaheim a "Road Easement" granting to the City an easement for public road and highway purposes in, on, over and across the following described real property situated in the City of Anaheim, County of Orange, State of California, subject to the terms, covenants and conditions therein set forth: PARCEL 1: That portion of the Southerly 175 feet of the South- west one quarter of the Northwest one quarter of the Southeast one quarter of Section 22, Township 4 South, Range 10 West, S.B.B. and M., described as follows: Beginning at the intersection of the West line of Lot 20, of Tract No. 190, as per map recorded in Book 23, page 50, of Miscellaneous Maps, in the of- fice of the County Recorder of said Orange County, with the South line of said Southerly 175 feet; thence South 89 54' 30" West, along said South line, 15.04 feet to the beginning of a tangent curve concave Northwesterly and having a radius of 15.00 feet, which curve is also tangent to said West line of Lot 20; thence Easterly and Northerly, along said curve, 23.61 feet to said West line; thence South 0 15' 33" East, along said West line, 15.04 feet to the point of beginning. PARCEL 2: That portion of the Southerly 175 feet of Lot of Tract No. 190, as per map recorded in Book page 50, of Miscellaneous Maps, in the office County Recorder, described as follows: Beginning at the intersection of a line that is parallel with and 60 feet Easterly, measured at angles, from the West line of said Lot 20 with South line of said Lot; thence North 89 54' 30 East, along said South line, 14.96 feet to the ning of a tangent curve, concave Northeasterly having a radius of 15.00 feet, which curve is a tangent to said parallel line; thence Westerly Northerly, along said curve 23.52 feet to said line; thence South 0 15' 33" East, along said line, 14.96 feet to the point of beginning. PARCEL 3: That portion of said Southerly 175 feet of Lot 20, described as follows: Beginning at the intersection of a line that is parallel with and 1,068 feet Westerly, measured at right angles, 20, 23, of said right the 11 begin and lso and parallel parallel from the East line of Section 22, Township 4 South, Range 10 West, S.B.B. and M. with the South line of said Lot 20; thence South 89 54' 30" West, along said South line, 15.03 feet to the beginning of a tangent curve concave Northwesterly and having a radius of 15.00 feet, which curve is also tangent to said parallel line; thence Easterly and Northerly, along said curve, 23.60 feet to said parallel line; thence South 0 15' 14" East, along said parallel line, 15.03 feet to the point of beginning. PARCEL 4: That portion of said Southerly 175 feet of Lot 20, described as follows: Beginning at the intersection of a line that is paral- lel with and 1,008 feet Westerly, measured at right angles, from the East line of said Section 22, Town- ship 4 South, Range 10 West, S.B.B. and M. with the South line of said Lot 20; thence North 89 54' 30" East, along said South line, 14.97 feet to the begin- ning of a tangent curve concave Northeasterly and hav- ing a radius of 15.00 feet, which curve is also tangent to said parallel line;. thence Westerly and Northerly along said curve 23.52 feet to said parallel line; thence South 0 15' 14" East, along said parallel line, 14.96 feet to the point of beginning. PARCEL 5: That portion of said Southerly 175 feet of Lot 20, described as follows: Beginning at a point in said East line of Section 22, Township 4 South, Range 10 West, S.B.B. and M., distant thereon North 0 15' 35" West, 833.52 feet from the Southeast corner of said section, being a point on a curve, concave Northeasterly, having a radius of 780 feet; thence Northwesterly along said curve, from a tangent which bears North 45 17' 15 West, through an angle of 17 15' 02 an arc dis- tance of 234.84 feet; thence tangent to said curve North 28 02' 13" West, 338.90 feet to a point in the South line of said Lot 20, said point being the Southwest corner of the land described and designated as PARCEL 1 in that certain road easement to the State of California, recorded August 13, 1953, in Book 2555, page 330, of Official Records, in the of- fice of said County Recorder and the True Point of Beginning of this description; thence North 28 08' 46" West, along the Southwesterly line of said land described and designated as PARCEL 1, 28.00 feet; thence South 41 22' 09" West, 32.97 feet to the South line of said Lot 20, thence North 89 54' 30" East, along said South line, 35.00 feet to said True Point of Beginning. SUBJECT TO: That certain unrecorded nursery license dated December 1, 1961, to Robert Hobbs, et al., (Affects all parcels). -2- ATTEST: Covenants, conditions, restrictions, reservations, encumbrances, easements, rights and licenses affect- ing the above described real property whether of record or not, including but not limited to those herein referred to. AND WHEREAS, Condition 9 of said easement provides that the City of Anaheim shall pay to Southern California Edi- son Company the sum of $200.00 to cover out -of- pocket costs in connection with the preparation and processing of said ease- ment; and WHEREAS, the acceptance of said easement by the City will be exceedingly beneficial to Leo Freedman, owner of property in the vicinity of the easement, and said Leo Freed- man has tendered to the City his check in the amount of $200.00 in payment of said out -of- pocket costs; and WHEREAS, the City Council finds that it is for the benefit and best interest of the City of Anaheim to accept said "Road Easement" this day submitted to the City Council by Southern California Edison Company. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the ''Road Easement" this day ten- dered to the City by Southern California Edison Company, a corporation organized under the laws of the State of California, granting to the City, but subject to the terms, covenants and conditions therein contained, an easement for public road and highway purposes in, on, over and across that certain real property hereinabove described, be and the same is hereby approved and accepted. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to accept said easement for and on behalf of the City of Anaheim. BE IT FURTHER RESOLVED that the check in the amount of $200.00 tendered to the City by Leo Freedman be, and the same is hereby accepted; and that the Finance Director be, and he is hereby authorized to pay to Southern California Edison Company the sum of $200.00 to cover the out -of- pocket costs of said Southern California Edison Company in the preparation and processing of said easement.
