1965-333RESOLUTION NO. 65R -333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1696. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Great Western Land Company, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: That portion of the Jonathan Watson Tract, in the County of Orange, State of California, as per map filed in Book 2, page 26 1/2 of Records of Surveys, in the Office of the County Recorder of said County, described as follows: Beginning at a stone on the North bank of the Santa Ana Valley Irrigation Co. Canal, marking the Southwest corner of the land formerly owned by Jonathan Watson, said stone also marking the Southeast corner of the J. D. Taylor Tract, as per map recorded in Book 36, page 58 of Mis- cellaneous Records, in the Office of the County Recorder of Los Angeles County, California; thence N. 29 45' 20" W. 1951.56 feet to the Northwesterly line of the land described in deed recorded August 6, 1947, in Book 1541, page 138 Official Records of said Orange County; thence along said Northwesterly line N. 53 35' 45" E. 470.67 feet; thence N. 51 59' 22" E. 436.44 feet; thence N. 56 30' 10" E. 577.03 feet; thence N. 67 18' 57" E. 664.61 feet more or less to the Northwest corner of the land described as Parcel 2 of deed recorded April 25, 1946 in Book 1404, page 464 Official Records of said Orange County; thence N. 69 57' 49" E. 386.27 feet along the Southerly toe of the Southerly dyke of the Santa Ana River to the intersection of the Westerly line of the land described in deed recorded May 4, 1954 in Book 2720, page 604 Official Records of said Orange County; thence along said Westerly line S. 9 33' 25" E. 1111.08 feet; thence leaving said Westerly line S. 23 22' 26" E. 8.00 feet; thence S. 80 23' 09" W. 193.40 feet; thence S. 23 22 26 E. 1008.80 feet; thence S. 66 20' 59" W. 47.71 feet to a tangent curve concave Southeasterly having a radius of 876.00 feet; thence Southwesterly along said curve 285.84 feet through a central angle of 18 41' 45 thence tangent to said curve S. 47 39' 14" W. 323.30 feet to a tangent curve concave Northwesterly having a radius of 574.00 feet; thence Southwesterly along said curve 338.12 feet through a central angle of 33 45' 01 thence tangent to said curve S. 81 24' 15" W. 335.19 feet to a tangent curve concave Southeasterly having a radius of 376.00 feet; thence Southwesterly along said curve 200.29 feet through a central angle of 30 31' 15 thence tangent to said curve S. 50 53' 00" W. 353.11 feet to the point of beginning. Containing an area of 101.141 acres more or less. EXCEPTING THEREFROM Lots 1 thru 65 of Tract No. 5000 as shown on a map recorded in Book 191, pages 28 thru 30 of Miscellaneous Maps, Records of Orange County. -1- AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on April 12, 1965, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1584, Series 1964 -65, recommending that Variance No. 1696 be denied; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the 4th day of May, 1965, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the following Anaheim Municipal Code minimum requirements: (a) A waiver of the minimum front yard setback; (b) A waiver of the minimum rear yard setback; (c) A waiver of the minimum side yard setback on a reversed corner lot; (d) A waiver of the minimum lot widths, on the property hereinbefore described, subject to the following conditions: -2- 1. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked Exhibits Nos. 1, 2, 3 and 4. 2. That this variance is granted subject to the completion of Reclassification Proceedings No. 64 -65 -108 now pending. 3. That this variance is granted subject to the annexation of subject property to the City of Anaheim. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 4th day of May, 1965.
